New cab company adds jobs & safe transportation in Cleveland

Written By kolimtiga on Jumat, 30 November 2012 | 10.49

CLEVELAND --  A new cab company is starting up in Cleveland, bringing jobs and safe transportation to the city. Wolley Cab owners could have picked any city in the U.S., but thought Cleveland had the most potential.

"We love Cleveland. Cleveland is like a quiet city. Chicago is really crowded," says Tom Ali.

Tired of the congested streets of the Windy City, Ali and the owners of Wolley Cab company, the Ibrahim family, set their sights on Cleveland -- a growing city in need of their services.

"They saw the business opportunity here with the casino, with the convention center, the Medical Mart," says attorney and company spokesperson, James Cullen.

The Ibrahim family had lived in Chicago for 20 years, but decided Cleveland was a better place to raise their family. They invested in the first 26 cabs with all the latest technology. They have a goal of growing their fleet to 100, which means more jobs for drivers and dispatchers.

Cullen says the cabs passed inspection, are licensed and ready to roll out.

And that name, Wolley?

"Wolley is yellow spelled backwards."

Maybe so, but this fleet is helping the city move in the right direction.

Cleveland: Judge sets bond at $2M for Camilia Terry

Written by
WKYC Web Staff

CLEVELAND --  The mother charged in the death of her 3-year-old son faced a judge in court Thursday morning.

Judge Pinkey Carr set bond at $2 million for Camilia Terry.

The 20-year-old is charged with aggravated murder in the death of her child, Emilliano.

During the brief arraigment which lasted only a few minutes, prosecutors gave more details on the injuries suffered by Emilliano.

Prosecutors described the child as having blunt force trauma to the  head and a skull fracture.  The prosecutors said it is estimated the child had been dead five to seven days when his body was recovered at a trash facility on Monday night.

The medical examiner hasn't officially determined the cause of death nor the time of death.

Terry said little during the court appearance, except to answer a question from the judge, and looked down for much of the arraignment.

Judge Carr also ordered Terry to have no contact with her other children.

Terry initially told police Emilliano went missing from a Cleveland park on Sunday evening. However, the search soon led to a trash processing facility near Cleveland and turned up the remains of the child wrapped inside multiple trash bags.

The Cuyahoga County Medical Examiner on Thursday afternoon positively identified the remains found at the trash processing facility as those of Emilliano.  The identification was made using DNA tests due to the decomposition of the body.

Results on the cause and time of death are still pending the outcome of tests.

A preliminary hearing in the case is scheduled for December 6.

Northeast Ohio claims portion of record Powerball jackpot

Written by
Associated Press

CLEVELAND -- Northeast Ohio had two Powerball winning tickets: one who took home a $10,000 prize and another overnight millionaire.

"I feel lucky myself for having sold the $2 million ticket," said Sam Seiler.

Seiler, a manager at the BP at West 117th Street, sold a $2 million Match 5 Power Play winner.

But a blind trust will keep the new millionaire a mystery.

James Graves isn't hiding his good fortune, trading 20 bucks for a $10,000 winning ticket.

"It was a roller coaster, a roller coaster last night," said Graves. "I knew pretty quickly that I hadn't won the jackpot, but I kept going and I realized that that had been the only number that I missed."

The 23-year-old Tri-C student bought his ticket here at Rite Aid, where he works 30 hours a week. The other workers helped him make picks - he asked them to think of a number, he guessed at it, and subtracted the difference.

"I thought it was kinda good to use more, maybe two minds are better than one, so I felt like it was kind of a collaboration to make good numbers," he said.

"Everybody always chooses sentimental dates or, I just felt like I wanted to mix it up," he said.

We followed him to cash in on his winnings.

The big check will go on the apartment wall, or maybe his ceiling. The money will buy some nice Christmas gifts and stay in the bank.

"As needed, I'm just going to work here, and just go to school, and not stress myself out too much," said Graves.

For now, he can't stop smiling.

"Keep on playing and hopefully your dreams will come true."

Investigator: Numerous abuse reports involving mom

Written By kolimtiga on Rabu, 28 November 2012 | 10.49

CLEVELAND -- By all accounts, Camilia Terry had a rough life, but she also dished out her share of abuse to her own children, including Emilliano, according to his father and those who knew her.

Police discovered the body of 3-year-old Emilliano Terry stuffed in a garbage bag at a local trash processing plant Monday night. They arrested his mother in connection with the death.

Camilia Terry was 14 years old and in the care of county social services in 2007 when she gave birth to her first child, court records show.

Related story: Mother of boy found dead laid her life out on YouTube

Three years ago, Terry brought Emilliano into the world, and just five months ago she had a third son.

A spokeswoman for Cuyahoga County Department of Children and Family Services said the agency has received a number of calls, alleging Terry abused her children, dating back to 2007.

However, none of the allegations was ever substantiated, said DCFS spokeswoman Mary Louise Madigan.

Emilliano's father, Shawn Dotson, says that Terry changed after the birth of their son.

"She wasn't the same," Dotson said. "She was very depressed and stressed out...miserable. He was neglected. She didn't really give him as much attention or really care for him like she did the other children."

Dotson says he hasn't seen Emilliano for more than a year, believing that he was still living out of state with his mother. He said Terry continually dodged his attempts to connect with the boy.

In fact, Terry sent Emilliano more than a year ago to live with her grandfather in Mississippi so she could concentrate on caring for her older boy and attend school, according to court records.

Dotson did not even know Emilliano was back in town until he heard news reports Sunday that the boy was allegedly abducted from an East Side park.

"I want to know what happened," Dotson said. "What did she do to him?"

Mildred Cobbs, the biological grandmother of Terry's oldest son, said she witnessed Terry physically and verbally abuse her two oldest children.

"I was really scared for the kids," said Cobbs, a school crossing guard who Emilliano called 'grandma.' "He was a sweetheart...a sweetheart."

Cobbs sought custody of the oldest boy in 2011 after Terry said she intended to send the boy to live with Emilliano at her grandfather's home in Mississippi, court records show.

She eventually dropped the complaint after Terry agreed to keep the boy in Cleveland.

Still, Terry mentioned several times to Cobb that she wanted nothing to do with the children, saying: "They get on my nerves. I just want them away from me."

Terry is no stranger to a difficult upbringing, according to DCFS records. She was first taken into DCFS custody as a 12-year-old after receiving allegations that Terry was abused.

The county first received reports that Terry was physically abused and neglected when she was just 8, said Madigan. An investigation found indications of neglect but could not substantiate the physical abuse.

Social workers received at least a dozen calls reporting that Terry was being abused, but none was substantiated, said Madigan.

Terry remained in DCFS custody until February, 2011 when the court terminated custody.  She re-entered the system five months later, seeking help with housing, food and energy assistance.

Terry's other two children, ages 5 months and 5 years, were taken into foster care on Sunday when police went searching for Emilliano.

Police: 10 more Jackson High victims ID'ed in coach investigation

JACKSON TOWNSHIP -- Police tell Channel 3 that 10 more victims have been identified on video in the investigation into former coach Scott Studer's videotaping of Jackson High School students naked in the boys' locker room.

That brings the total number of victims to 74.

Police say Studer, 46, the head freshman basketball coach put cameras in the boys' locker rooms shower area on multiple occasions dating back to 2005.

He remains in the Stark County jail, so far facing eight felony charges of illegal use of a minor in nudity.

Studer is well known in the community, and was well liked by the students at Jackson High School. He has coached basketball for 27 years and is an alumni of Jackson High School.

He resigned the day he was arrested.

In addition to coaching, he'd been employed as a building aide, checking visitors in and out of the front office. Studer also had access to security cameras at the school.

Jackson Township Police assisted U.S. Postal Inspectors in serving a search warrant at Studer's home Nov. 14, in a separate investigation of child pornography.

Inside the home, they discovered media, containing footage from inside the basketball locker room shower area.

Upon questioning Studer, police learned Studer had assembled and disassembled hidden cameras in the locker room as he went in and out of the facility over the years.

Police believe more charges are pending, on a state and federal level. Investigators are not sure how many hours of footage Studer recorded, or how many students he filmed over the years.

High School parents who found out about the investigation through their children are angry that the district did not notify parents first.

Police: Missing 3-year-old found dead in trash bag

CLEVELAND -- Police say the body of missing 3-year-old Cleveland boy Emiliano Terry was found in trash bags at the Waste Management recycling center in Oakwood.

During a 9:45 p.m. press conference Monday at the Justice Center, police said they have arrested Emiliano's mother, Camilia, and she is being held in jail.

The discovery of Emiliano's body was made about 4 p.m. Monday. The Cuyahoga County Medical Examiner's Office will perform an autopsy Tuesday morning to determine the cause of death.

Camilia Terry's other two children are now in the custody of Cuyahoga County Children & Family Services.

Police say they became suspicious of 20-year-old Camilia Terry's statements when they became "inconsistent" earlier Monday.

As the FBI evidence team was searching the streets around Terry's apartment near East 130th Street and Broadway Avenue about 2 p.m. Monday, they noticed a Waste Management truck picking up recycling containers and recyclables.

They contacted Waste Management after getting the number of the truck and asked that the truck be held at the Oakwood facility until they could arrive.

Once they arrived, they had the truck dump its load inside the facility and began searching through the bags. They found the body double-bagged after opening several bags.

Police were asked if they knew when Emiliano had been killed and they said that the Medical Examiner's Office would make the determination Tuesday as to how long Emiliano had been dead.

Police said the investigation is now in the hands of the Cleveland Police Homicide Unit and they will be meeting with the prosecutor's office Tuesday morning to determine the charges against Camilia Terry.

Ohio State Buckeyes defeat Michigan 26-21

Written by
WKYC Web Staff

COLUMBUS -- The Ohio State Buckeyes have defeated the Michigan Wolverines, 26-21, and have completed their season with a perfect 12-0 record.

Carlos Hyde ran for 146 yards and No. 4 Ohio State's defense shut out 20th-ranked Michigan in the second half completing an improbable 12-0 season for the Buckeyes.

It was a sweet win for the Buckeyes, just 6-7 last season with a loss to their archrivals in a transitional year in which they were facing heavy NCAA penalties. After Urban Meyer took the job as head coach a year ago, they were socked with a bowl ban after this season - and still ran the table.

Ohio State (12-0, 8-0 Big Ten) is ineligible for a BCS national title but still has an outside shot at finishing No. 1 in the final Associated Press Top 25 if other contenders lose. Michigan (8-4, 6-2) will now await a minor bowl bid.

Drew Basil matched his season output with four field goals and the defense did the rest, forcing three turnovers in the second half. It was played before 105,899, the largest crowd ever to witness "The Game" in Columbus.

This is the 6th perfect season for the Buckeyes. Some polls say the Buckeyes would be ranked as high as No. 3 in BCS standings if they were not on probation.

A home game for the Buckeyes is worth about $3 million to the university.

Here's an inside look at the Buckeyes budget according to Forbes magazine:

For 2011-2012, revenue for the Ohio State football team is $48 million.. For the 35 other sports combined? $18 million.

The Buckeyes are perfect this year on the field, but will suffer an estimated loss of $2.2 million in bowl revenue due to NCAA sanctions.

But along with all this scarlet and gray, businesses will keep seeing green.

Need a ticket for the game? Ohio-State Michigan is still the hot seat.  We found tickets on Stub Hub going for as high as $950 each.

This game is about cash...and confidence.

Cleveland Weather: Oh no! Lake snow!

Cold air flowing over the warmer waters of the Great Lakes.

That is the simple explanation of lake effect, which is a wind driven event.  The wind direction arrows will point to where the snow will go, and in this case - right into the heart of the snowbelt.

We are looking at 2" to 5" of accumulation for the primary snowbelt areas in eastern Cuyahoga, far southern Lake, northern Geauga, northern Trumbull counties, and most all of Ashtabula county.  These are the areas with the Lake Snow Advisory through early Sunday morning.

For Lorain, western and southern Cuyahoga, Medina, Summit and Portage counties (secondary snowbelt) expect less than 2" of accumulation.

Otherwise it will be cloudy, cold and windy.  Wind chills will drop into the 20s and likely stay there for Saturday, since the temperatures won't be leaving the middle 30s.

The lake snow may linger into early Sunday before ending.  Mostly cloudy to partly sunny skies will then rule.

Still watching a storm system for Tuesday...might be snow or could be nothing at all.  Let's get through this weekend first.

Tonight:  Scattered lake snow, otherwise cloudy, windy and cold.  Upper 20s/low 30s

Saturday:  Scattered lake snow.  Mainly cloudy.  Breezy and cold.  Mid 30s

Sunday:  Early flurries may linger north, otherwise mostly cloudy to partly sunny.  Breezy.  Upper 30s/near 40

Monday:  Early sun giving way to clouds and then a chance for showers later in the day.  Near 40

Tuesday:  Mainly cloudy with a chance for snow.  Upper 30s

Wednesday:  Mostly cloudy with scattered light snow chances.  Near 40

Thursday:  Partly sunny.  Low 40s

Friday:  Partly sunny.  Low 40s

Cleveland Weather: The Friday Plunge

Written By kolimtiga on Jumat, 23 November 2012 | 10.49

Northern Ohio has a lot to be thankful for on this Thanksgiving holiday.

First and foremost as far as the weather is concerned is our stretch of sunny skies and mild temperatures.

So, now that we have recognized how thankful we are, we have to get ready for tomorrow.  We won't be as thankful for the weather tomorrow.

A strong cold front will be plowing through the area in the morning.  This will mean a mild start with gusty wind and rain showers.  Once the front comes through we may see a few peeks of sun before scattered snow showers begin.  The scattered snow will then continue in the snowbelts overnight and into Saturday.

As far as lake effect "events" go, this one won't be all that memorable.  Accumulations in the heart of the primary snowbelt will range from 2" to 5".  Outside of primary territory, we'll find some flurries flying but accumulations won't add up to much, if anything at all.

The lake effect will be shut down on Saturday as the winds start shifting.

Sunday looks great.

Monday we'll be watching for the track of our next storm system due to arrive Tuesday.  Path is everything with these storm systems, but for now it looks like rain changing over to snow.  Another round of accumulations (not just in the snowbelt) looks likely, although how much is very much in question.

Happy Thanksgiving to you and yours.

Tonight:  Increasing clouds.  Mild and breezy.  50s

Friday:  Cloudy, breezy and rainy to start, then windy with some breaks in the clouds. Scattered snow develops as temperatures drop. Temps start near 50 (very early morning), then fall into the 40s and 30s as the day passes.  Little, if any, snow accumulation.

Friday night:  Mostly cloudy, breezy and cold with scattered lake effect snow showers.  Accumulations in the primary snowbelt will range from 1" to 3".  Mid 20s west with near 30 to low 30s east.

Saturday:  Partly sunny and cold west.  East: Mostly cloudy with scattered lake effect snow showers.  Very little accumulation most areas, but another 1" to 2" possible in the eastern portion of the primary snowbelt.  Breezy and cold.  Mid 30s

Sunday:  Lingering lake effect snow chances in far eastern areas, otherwise mostly cloudy to partly sunny.  Chilly.  Upper 30s/low 40s

Monday:  Partly cloudy.  Rain and/or snow chances late day.  Low 40s

Tuesday:  Rain changing to snow as temperatures fall from the low 40s.  (We will be keeping a VERY close eye on Tuesday's forecast...)

Wednesday:  Scattered snow showers, otherwise mostly cloudy.  Upper 30s

Thursday:  Partly sunny.  Upper 30s/low 40s

Kent: Five generations get together for Thanksgiving

KENT -- There's not much space at Henry Brown's home once you get more than thirty family members inside.

"There's a lot of love and you can't beat love," said Henry.

Five generations of love join each year at Thanksgiving under Brown's roof.

"It's special every year to know that we all are still together," said Linda Lockett, one of Henry's eight children.

"I am thankful for being here to spend this day with my family. Being here to collect these memories to carry on," said Renita Claridy.

Henry and Gloria Brown have been married more than 60 years. They had eight children, who had 15 grandchildren. The number of great-grandchildren and great-great grandchildren keeps growing.

It's three-month old Beverly's first Thanksgiving.

And they say she'll learn quickly this family enjoys each other as much as the meal itself.

"Oh yeah, I cooked for many years but no more," said Gloria.

"Everybody says just bring a dish...somebody makes the meat and everybody else makes a side dish," said Lockett.

What are they grateful for today?

"Family. That they haven't...you know...they've dealt with me for so many years," said Miles Brown, a great-grandchild.

They don't all fit at one table, but the meals are enjoyed in close company, just like Henry hoped.

"I always wanted a big family," he said.

"You eat a lot and you talk a lot and you laugh a lot," said Lockett.

Cleveland Heights artist communicates with paintings

Written by
WKYC Web Staff

A typical day for 28-year-old Seth Chwast involves hours upon hours of working in his art studio, a brightly lit room on the third floor of his Cleveland Heights home.

"When he paints, he's happy," says Debra Chwast, Seth's mother.

For Seth, painting also allows him to communicate with the outside world, something he otherwise can't do.

"A little before [Seth] was two, we found out he was autistic," explains Debra. "He was sunny, he was happy, and he didn't talk."

Debra says she tried therapy after therapy to jump-start Seth's speaking, but nothing worked.

"When he was 12, I understood that he was not going to wake up and start speaking," she says. "Part of it was heartbreaking and part of it was liberating."

Instead on focusing on what Seth couldn't do, Debra insisted on tapping into his passions. That included many trips to haunted houses and rollercoaster parks. He also had an affinity for Nintendo games and even ballroom dancing.

But an art class that Seth took at the age of 20 changed everything.

"He hit the ground running," says Debra.

Seth's artwork has landed him on the "Today Show" and he has had exhibits all over the world, including the Cayman Islands, Ukraine and at the United Nations in New York City.

"I couldn't have a son who would be a doctor or go to Harvard. It was not in the cards, so I stopped thinking about everything that society taught me to value, and I just thought what is real and what's real is joy," Debra says.

For Seth, joy comes from putting paintbrush to canvas and sharing his work with the world around him.

"He says his paintings can make people all better and I think he's right."

Cleveland Weather: Feeling foggy?

High pressure cleared the skies for northern Ohio today.

Those same clear skies may allow for some fog to form overnight.  We are in a tricky spot as far as the fog is concerned, since areas west of us dealt with very dense fog this morning.  So, what is west will move east... but, wind will be the deciding factor for our fog.  We are expecting a southerly breeze to develop overnight which should keep the fog from getting crazy.  If, however, those breezes don't come in as expected (which happens), then dense fog is possible.  I'll be keeping an eye on this tonight.

What is left of the fog will mix out Thanksgiving morning and we'll be enjoying sunshine once again.  Highs are expected in the upper 50s to low 60s.

Then Friday...

A strong cold front will sweep through the area late Friday morning.  That means rain is likely with gusty wind and temps in the upper 40s to start.  Once that front goes through the mercury starts to drop and the rain will change over to lake effect snow for later Friday into Saturday.  Some areas in the snowbelt could be measuring snow this weekend!

High pressure comes back to us on Sunday, which means more sunshine, but the temperatures will still be chilly.  If you are going to Browns Stadium, you had better pack on the layers and bust out the long johns.

Monday into Tuesday and Wednesday we'll be feeling the effects of a storm system that will bring us rain and then snow.  Still working on the details for that one, but stay tuned.

Happy Thanksgiving everyone!

Tonight:  Clear and cool.  Areas of fog developing.  Upper 30s/low 40s

Thursday...Thanksgiving Day: Early fog, then mostly sunny & mild. Upper 50s/near 60

Friday...Black Friday:  Mostly cloudy with rain and falling temperatures. Windy. Rain may mix with and change to snow late Friday into Saturday. Upper 40s thru late AM...then falling

Saturday: Mostly cloudy with scattered lake effect snow showers. Colder and brisk. Mid/Upper 30s

Sunday: Partly cloudy to mostly sunny, breezy & cool.  Near 40

Monday: Partly sunny.  Slight shower chances late. Low 40s

Tuesday:  Cloudy with rain showers.  Upper 40s

Wednesday:  Mostly cloudy with scattered snow showers.  Mid/upper 30s

Cleveland: Suspects lead police on intense pursuit

Written by
WKYC Web Staff

CLEVELAND -- Cleveland Police canvassed the west side searching for two suspects Wednesday night.

An intense police chase began shortly after 7:30 p.m. near West 140th and West Blvd after police saw two men wanted on numerous felony warrants.  Vice Detectives attempted to stop the 2 men. They refused and the pursuit began.

The chase intensified when the suspects sideswiped a detective car.

The suspects crashed their car near I-90 and West Blvd into a wooden barricade and then continued running on foot.

Neighbors near the crash scene are speaking with police. One neighbor has surveillance cameras in their yard which police are viewing and another resident took a picture of the suspects.

One suspect was taken into custody as police continued searching for the second man, 21-year-old Patrick Terrell Carner, who they say is armed and dangerous.

Anyone with any information is urged to call Cleveland Police at 216.623.5218.

St. Augustine's Tremont plans on serving 17k Thanksgiving meals

All across Northeast Ohio, charities and hunger centers are preparing for one of their busiest days of the year. This Thanksgiving, the need in our own community is growing.

"I start cooking turkeys in October. It takes a long time," says Sr. Corita Ambro, with St. Augustine's in Tremont.

The Hunger Center already serves 3 meals every day of the week. But this Thanksgiving, the local church plans on serving 17,000 meals at 3 different locations and delivered to homes.

Sr. Corita says there are more families calling for meals this year compared to years past. And in some cases, the Hunger Center is the only family visitors have.

"One person I met the other day, I was saying something about going home to see your mom and he said, 'my family doesn't want anything to do with me.'"

St. Augustine's delivers from Lorain all the way to the far east side and all across Northeast Ohio. They have plenty of people serving on Thanksgiving Day, but they still need drivers to take meals to shut-in's and people in need.

Contact St. Augustine's to help

Sr. Corita says the Hunger Center is still in need of food donations and financial donations.

If you can help, call (216) 781-5530 or contact St. Augustine's here.

Highway Patrol: Wednesday deadliest night for driving

Forget New Year's Eve. The Highway Patrol says Wednesday is the deadliest night of the year on the roads.

It's all because of people who make the decision to drink and drive.

Tuesday a local mother learned she'll spend the next 3-years behind bars because she chose to drink and drive.

Channel 3's Dave Summers was there for the emotional sentencing.

The Ohio Highway Patrol says over the four days of the Thanksgiving celebration last year, 17 people died in car accidents. A third of those were caused by drunk drivers.

With 43 million people driving at least 50 miles from home on this holiday, let Westlake's Jenny Kearney's regrettable decision to drive drunk be a warning.

Kearney pleaded guilty to aggravated vehicular homicide. The maximum penalty was eight years. She was sentenced to three years behind bars plus a $1,000 fine.

We want to show you what drunk driving is like so we used the new drunk-driving simulator at the Ohio Department of Transportation in Garfield Heights.

It's a good lesson learned without the serious consequences.

Turkey Day deals: Where to buy for the best prices

Written By kolimtiga on Selasa, 20 November 2012 | 10.49

CLEVELAND -- To top off your Turkey Day and leave some cash left over for Black Friday, you've got to shop around.

As Channel 3 News found, you likely won't find the best deals all in one place.

We made calls and scanned the ads for five well-known grocery chains in our area: Dave's Supermarkets, Giant Eagle, Heinen's, Marc's and WalMart.

"I go to Aldi's first and get all the cheaper stuff and then get the better quality stuff at Giant Eagle," said Danielle Satorious.

For the cheapest bird, look for a frozen turkey around $0.79 per pound. You can find this price at WalMart, Marc's, or Giant Eagle. Some Dave's offer turkeys at $0.69 per pound with an additional purchase.

If you want to splurge on fresh, free-range or organic, the turkey is where to spend.

For side dishes, WalMart's a clear winner at a sale price of $2.47 for a ten-pound bag of potatoes.

Stuffing depends on what brand you are looking for, fresh or bagged, or already prepared. The absolute best price we could find was WalMart at 98 cents a box.

For some, time is the priority.

"I have a menu in mind of what I want to serve, and I just, I look for the most convenient, not necessarily the cheapest," said Michelle Ricciarelli.

"Ready-made pie, ready-made lot of stuff," said Ricciarelli, with a laugh.

What about pumpkin pie? WalMart wins here as well, at $2.98 for an 8" pie.

Of course, quality, convenience and coupons may affect where you shop and what price you'll pay.

When in doubt, choose store brands over name brands, and frozen, canned or dried items over fresh.

That will save you money even when the leftovers are gone.

Cleveland: Council proposes tougher traffic code penalties

Written by
WKYC Web Staff

CLEVELAND -- Councilman Conwell introduced an emergency ordinance at Monday night's Cleveland City Council meeting intended to keep residents safe from those who violate traffic codes.

This amendment would increase the penalty for not stopping when a school bus is stopped to a first degree misdemeanor, license suspension is maintained.

The ordinance needs to receive the affirmative vote of two-thirds of all council members and would take effect either immediately upon being passed and the Mayor's approval or after the earliest period allowed by law.

The traffic code would include street racing, licensing drivers, accidents, willfully fleeing a police officer, stopping for school buses, placing dangerous material on streets, and bicycle safety violations.

Local reaction to Middle East conflict

Written By kolimtiga on Senin, 19 November 2012 | 10.49

CLEVELAND -- Tensions between Israel and Palestine continue to escalate.  Sunday marks the fifth straight day that Israeli's and Palestinians have spent launching missiles and rockets in and out of the Gaza Strip.

Case Western Reserve University Political Science Professor Dr. Peter Moore says the violence reached the next level Thursday when Israelis killed a high commanding Hamas leader.

Israeli troops have gotten ready for a possible ground invasion of the Gaza Strip. Dr. Moore says the outcome would be catastrophic. The Gaza Strip itself, he points out, is one of the most densely populated places on earth.

The majority of the Palestinians who reside there are civilians, many of whom, Dr. Moore says, currently do not support Hamas.

According to Dr. Moore, only 25 percent of Palestinians support Hamas, and a whopping 60-70 percent of the population is under the age of 18.

"Civilians have no safe space to go to. There are no bomb shelters in Gaza, no place for civilians to flee the strip," said Dr. Moore.

Israel's response comes after the firing of more than 500 rockets from Gaza into Israel.

While Israel says it's going after militant targets in Gaza, it's hard to tell with Hamas.

"What they [Hamas] are doing is firing in the general direction of things and there's no way to know where it's landing," said Dr. Moore.

There have been civilian casualties on both sides.

Mark Davidson, a local member of the Jewish community, was hoping that the two groups would find a peaceful solution to their problems.

"I feel terrible about it. I've been to Israel four times, I have family there," said Davidson.

He is still holding out hope for that peaceful solution, and is afraid to think of what would happen if things escalated further.

"I'm concerned for people's lives, property and the whole state of the country in general."

No. 6 Buckeyes beat Wisconsin in OT, 21-14

Written By kolimtiga on Minggu, 18 November 2012 | 10.49

Written by
Associated Press

MADISON, Wis. -- Carlos Hyde scored on a 2-yard run in overtime Saturday, giving No. 6 Ohio State a 21-14 victory over Wisconsin and keeping the Buckeyes' hopes of a perfect season alive.

The Buckeyes (11-0, 7-0) clinched the Leaders Division title outright with the win. But they are ineligible for the postseason as part of their punishment for NCAA violations under former coach Jim Tressel, and the best they can hope for is to end the year unbeaten and to maybe capture the AP Top 25 title.

Montee Ball scored his 78th touchdown, tying Travis Prentice's major-college record for career scores. But he fumbled on what would have been the record-breaker with 2:46 left in regulation.

The Badgers forced overtime anyway, on Jacob Pedersen's 5-yard catch, but Curt Phillips couldn't find him again in overtime.

Frank Russo reports to federal prison

Written By kolimtiga on Sabtu, 17 November 2012 | 10.49

Former Cuyahoga County Auditor Frank Russo has reported to a federal prison in Lorreto, Pennsylvania.

Russo arrived about 11:30 a.m., dropped off by a Mercedes with Ohio license plates, driven by an unidentified man.  The driver left alone about a half hour later, presumably to begin the four-hour trip back to Cleveland.

Russo immediately began the orientation process for new inmates, which includes the issue of prison pants, shirt, and jacket, and a series of meetings, which can extend into several days.

When Russo might walk out a free man from the Loretto Federal Correctional Institution won't be known for at least several months.

That's because Russo's work isn't done yet. Russo, who testified against his former partner in crime, Jimmy Dimora, is still scheduled to testify again, this time against attorney Anthony Calabrese III in February.

Calabrese is a Cleveland attorney indicted on multiple corruption-crimes and racketeering. Russo is facing 22 years but it's not set in stone.

U.S. District Court Judge Sara Lioi could agree to reduce Russo's sentence in exchange for his cooperation with prosecutors, but that won't be decided until maybe after he takes the stand against Calabrese in February.

Until then, Russo will live alongside 1,300 other prisoners in a small room where it will cost taxpayers about $73 a day.

Parma: Historic Parma Theater caught fire

PARMA -- 30 firefighters from three cities were called to a fire at the historic Parma Theater Friday afternoon.

The fire was brought under control just after 6 p.m.

The Parma Fire Department says the owner of the store next door reported the fire.

Firefighters from Parma, Brooklyn, and Parma Heights quickly extinguished the fire, which was contained to the lobby.

There were no injuries reported.

Fire inspectors are looking into what may have caused Friday's fire and are still calculating a damage estimate.

Ridge Road reopened shortly before 9 p.m. Friday night.

The theater closed Sept. 9 and a sign out front reads "Closed. Thanks for your patronage."

The theater stopped showing movies during the week because of poor attendance at the beginning of the year.

The building was for sale with an asking price of $795,000 and needed interior repairs.

The theater was built in 1936.

Investigator: Unclaimed millions in life insurance cash

Written By kolimtiga on Jumat, 16 November 2012 | 10.49

Could you be among the thousands of Ohioans who are supposed to receive thousands of dollars from unclaimed life insurance policies?  The state is holding $73 million in unclaimed  benefits, with some indivdual beneficiaries owed as much as $500,000.

Channel 3 News Investigator Tom Meyer obtained a state database, showing there are 240,000 policies that Ohioans haven't claimed for one reason or another.

In some cases, life insurance companies fail to notify the beneficiary of the policy. In other cases, beneficiaries haven't been told of the policy or they simply forgot about the policy when a loved one passed away.

Rosie Maksym, of Parma, doesn't believe the insurance company told her mother, Eileen, about a $59,000 policy Eileen's husband took out before he died six years ago.

"Its unspeakable if that's what they're (life insurance companies) doing. They're trying to con people, to swindle them of what's deserved to them," said Maksym.

Life insurance companies have three years to try to contact beneficiaries following a policyholder's death and, if they fail, they're required to turn the money over to the state.

Channel 3 News found Frank Fencl living in Lakewood. The state has nearly $87,000 of his money -- a life insurance policy left for him from his deceased Aunt.

"Could you use the money?" Meyer asked.

"Oh yes, very, very much," Fencl said.

The trade group representing insurance companies, the American Council of Life Insurers, says companies do their best to track down beneficiaries.

The group says it works with regulators and lawmakers on ways to insure that beneficiaries get the money they're due. Last year, the life insurance industry paid out $62 billion in benefits.

Ohio is one of two states that provides a free service, helping families of deceased loved ones find possible life insurance polciies.

You can file a request with the Ohio Department of Insurance and it will do the legwork. In two years, the department has heard from nearly 1,400 people. There have been 651 matches.

In addition, you can find out for yourself if you're owed money.  Channel 3 News has included the state database that lists names of beneficiaries, their addresses, the names of the insurance companies, and the amount that's owed.

To use the database (located above and to the left of the article) put in a name to search.  Click on the blue link in the search results to find out more details about a particular claim.

Willoughby: Crash victim charged in CVS robbery, stabbing

Written by
WKYC Web Staff

WILLOUGHBY HILLS, Ohio -- Willoughby and Willoughby Hills police are investigating a car crash, robbery and stabbing that all appear to be connected.

The suspect attempted to rob a CVS/Pharmacy at Som Center and Ridge roads in Willoughby. He also stabbed the store clerk in the hand.

At approximately 2 a.m. Thursday, the Willoughby Police Department received a call from a female cashier at the CVS Pharmacy that a man had attacked her with a knife and ran off when she screamed.

She said she had suffered a cut to her hand but was not seriously injured. Co-workers followed the man out of the store and were able to advise dispatch that he left in a Ford Escort heading eastbound on Maplegrove Road towards Willoughby Hills.

The Willoughby Hills Police Department spotted the suspect vehicle southbound on River Road traveling at 70-80 mph and initiated a traffic stop.

The suspect vehicle, a 1998 Ford Escort, tried to drive away and ultimately crashed. The crash occurred on River Road near the Gates Mills border.

The driver, later identified as Albert D. Rose, 57, of Cleveland, was ejected from his vehicle. Rose was taken to Hillcrest Hospital for injuries suffered from the crash.

A knife and clothing similar to that worn during the robbery was recovered from Rose. Officers speaking with the cashier and reviewing surveillance video learned that Rose entered the store and waved to the cashier.

Rose then selected cough syrup from the pharmacy department. Rose proceeded to the checkout area and placed the cough syrup on the counter.

According to the cashier, Rose mumbled something to her as she began ringing up the sale. When she asked him what he said, Rose pulled out a knife and tried to grab her collar.

The cashier screamed and was knocked down.

The cashier, a 21-year-old, Willoughby woman, suffered a small cut to her hand while attempting to pull away from the suspect.

She was treated by the Willoughby Fire Department and released on scene.

Albert Rose is facing charges of aggravated robbery, a felony of the first degree, and felonious assault, a felony of the second degree.

Warrants for his arrest have been issued and will be served when he is medically clear.

Cleveland: Casino to recreate Higbee's holiday

CLEVELAND -- The Horseshoe Casino will draw on Higbee's history when it decorates for the holidays.

"We feel that what we're going to put together, in combination with all the other great offerings downtown, will be very compelling," said Marcus Glover, general manager of the casino, at a Thursday news conference.

The Horseshoe will recreate some of the historic holiday decorations which generations of Greater Clevelanders came downtown to Higbee's to see.

Among them are the garland arches across what is now the first-floor gaming area.

"Come on down and see what's going on because we feel it's going to be very exciting," Glover added, emphasizing the idea was not necessarily to get more people into the casino, but just downtown for the holidays.

The original Higbee's display windows will be restored with Christmas fare, and several trees recovered from storage in what was the old department store have been restored and will be on display.

"We are adding 9,000 new lights to one of them," says Cynthia Klein, of Room-2-Room, the Akron design firm leading the creative process.

More holiday visitors downtown is good for all of Cleveland, says Steve Siedlecki, who operates the house on West 11th Street made famous in the 1983 movie "A Christmas Story."

"I really believe that  Cleveland can get back what it once had," Siedlecki told WKYC.  "I know in a lot of areas we have, and with just a little more work, yeah, I think it can be great again, and we're here to be part of it."

"We see a lot of it with the guests that come here and what's going on downtown it overflows to people coming here," he added, as two trolleys packed with tourists rolled past the Christmas Story House.

"Everything going on downtown, from the casino and everything else being built, we've seen the increase."

David and Ann Markey, who traveled from Dayton to tour the house, said even they knew about Higbee's through the movie.  They were pleased some of the old decorations would be revived.

"I think it's great. It is.  It's a great idea," they chimed in together. "It'll bring a lot of people here.  I think that's what everybody loves the movie, the opening at Higbees. It gives them a feeling for Cleveland the way it really is, a great town."

Northeast Ohio charities need help to help others

Written By kolimtiga on Kamis, 15 November 2012 | 10.49

CLEVELAND -- It is a growing concern among many of the Northeast Ohio charities -- families going hungry.

"We want anyone that needs help this Christmas season to come to the Salvation Army on Monday," said Major Lurlene-Kay Johnson, with the Salvation Army.

The Salvation Army expects over 3,000 families to sign up for their Christmas Assistance program on Nov. 19 in Cuyahoga County alone.

"We are seeing more and more people come in from the suburbs, in fact, the suburbs are seeing a 75 percent increase of people living below the poverty level," the Major added.

At least 1 in 4 children are at or below the poverty line here in Cuyahoga County. The Salvation Army wants to raise at least 25,000 toys to give to those children.

But there is a greater need, the need for food. The federal government is slashing food benefits this year and the cuts will be deep.

It is because of last year's winter was mild and electrical power bills were so low. The government uses a formula based on utility bills and, come January 90,000 local families could lose up to $50 a month in food stamps.

It is a thought Anne Goodman, the President and CEO of the Cleveland Foodbank, can't live with.

"I think about those children who will not grow appropriately without proper nutrition and when I think of the problem getting worse, it breaks my heart. With cuts like these, I don't know how we are going to do it. Real families, real children are going to be directly impacted by this soon."

More and more families are hurting financially and a bigger burden will be placed on local food banks.

According to Michelle Hilton, with the Akron-Canton Regional Foodbank, an eight-county area could lose up to $120 million annually, bringing the need to donate to an all-time high.

"At the rate we are going, we are going to be falling behind and we have a community that needs to help us to make sure that we don't fall behind." Goodman adds.

Items that you can donate to your local charity are:

Peanut Butter

Canned Vegetables such as beans, greens, carrots, potatoes, and tomato products

Canned meals like stew or chili

Boxed Cereal

Paper Products like towels, facial tissue and toilet paper.

Click The Salvation Army, The Cleveland Food Bank and Akron-Canton Foodbank for a more detailed list on what your area needs.

Clyde: Playground built over deadly chemicals

Clyde, OHIO -- An EPA study found a community playground sits on as much as 9 feet of toxic sludge.

The report, which was posted online October 28, reveals the results of soil tests in and around Whirlpool Park, a community playground in Clyde, a town of 6,000 located about 90 minutes southwest of Cleveland.

"These are all carcinogens these chemicals, and they give credence and can cause the cancers that we've seen in the children of Clyde," attorney Alan Mortensen announced at news conference Wednesday at the Clyde Public Library.

Mortensen's firm represents a number of families in Clyde who have lost loved ones in recent years to cancer.  He said there is a 95 percent chance the cancers in dozens of Clyde residents were caused by an outside source.

"I grew up playing at that park,' said Clyde resident Trina Donnersbach, whose daughter Shilah died at the age of 20 in 2007, two years after being diagnosed with a huge tumor in her pelvic bone.

"She also did play at the park," Donnersbach said, believing that the toxins in Whirlpool Park were the cause of her daughter's disease. She displayed pictures of Shilah during the news conference.

Two generations of Clyde-area residents played and swam in the park which was closed in 2002 and sold to a private owner by Whirlpool three years later.

That owner did not know of the deadly toxins the EPA said are within 6 inches of the surface in some cases.

The current owner, who was going to build homes on the site, has reportedly offered to turn the 35-acre parcel of land back to Whirlpool, which has refused, according to the residents' attorneys.

Whirlpool has been Clyde's major employer for decades and has done a lot of good for the community, said attorney Dustin Lance, who added, "What we're concerned about is that the community is not aware of the other activities that Whirlpool was involved in that have caused substantial risk to this community and to their families."

In its 106-page report, which recently appeared online, and of which the people of Clyde were not made aware, also identified several other sites in and around the town with potentially cancer-causing chemicals.

Attorneys say although it is highly likely there is a connection between the cancers and the soil, air, or water in Clyde, it is not certain, and the source may not specifically be Whirlpool Park.  However, they say virtually all the people affected by cancer, or in the case of children, their mothers, spent time there.

Mortensen said it is possible PCB contamination could have passed from mothers to their unborn children, with cancers developing as the children grew up.

Some residents were furious that the U.S. EPA never told them of their findings, and that they had to happen upon it by chance online.

"The family members want to be involved and want to be informed and want to know what's going on," said Mortensen, who called the situation an outrage, "because it's their children who have been affected by this."

Residents and their attorneys were also perplexed that the Ohio EPA, the state health department, and various local agencies never found the concentrations of potentially deadly chemicals which the U.S. EPA unearthed when it did 16-foot-deep core samples at all the sites in June.

Warren Brown, whose daughter Alexa died at the age of 11 after a valiant 3-year battle with brain cancer, held up a picture of the little girl at the community news conference and made a solemn declaration.

"When Alexa lay on her deathbed," he said, slowly and deliberately, "I told her her death would not be in vain. We are going to get some answers."

Jackson High coach charged with videotaping nude boys

MASSILLON -- Police have arrested and charged a Jackson High School coach for bringing video recording devices into the boy's locker room, focusing on the shower area of the locker room.

Police charged Scott D. Studer, 46, of Massillon, with eight counts of the illegal use of a minor in nudity-oriented material and took him to the Stark County Jail.

A news conference was held at 5 p.m. where Police Chief David Zink and School District Superintendent  Chris DiLoreto spoke.

Several angry parents were there and asked why their children had to tell them about this and that the school district had not notified the parents.

After 22 minutes, Zink and DiLoreto abruptly ended the press conference as parents kept asking more and more questions.

The investigation was one being done by the U.S. Postal Service in a larger child pornography case, Zink said. Local police were just brought into the investigation Wednesday morning.

Studer has worked for the school district for about 25 years.

Zink said there "is nothing to suggest that he shared or traded any of the images." He said the activity of videotaping the boys began back in 2005.

Zink added that they are at the beginning of the investigation and they are just starting to try and identify the boys involved.

Zink said the cameras were never left in the locker room.

Police say that at 6:15 a.m. Wednesday, Jackson Township detectives assisted United States Postal Inspectors in the execution of a search warrant at 5141 Pin Oak Drive NW in Massillon.

Police said there was evidence recovered implicating Studer in the production of the illegal use of a minor in nudity-oriented material, a second-degree felony.

Studer brought video recording devices into the boy's locker room at Jackson High School, focusing the cameras on the shower area of the locker room.

Studer was employed by the Jackson Local School District in the capacity of Building Aide and Head Freshman Basketball Coach.

He tendered his resignations from both positions effective Wednesday.

Mentor: Man with machete, gun arrested outside school

Written By kolimtiga on Rabu, 14 November 2012 | 10.49

MENTOR -- A Mentor-on-the-Lake man was arrested after challenging police at the Cardinal Autism Resource and Education Center.

Police said he had a machete in the back seat of his car and a gun on the center console in the front seat.

Police arrested Armand R. Dinardo Jr., 46, the ex-husband of one of the center's employees.

Police said they were called to the center on Forest Road just after 11 a.m. Tuesday for a disturbance complaint.

The complainant, who is employed at the center, said that she and her ex-husband Dinardo are currently in a custody dispute involving their teenage daughter.

Dinardo had driven the daughter to the center to pick up her cell phone from the mother, police said.

The mother advised her daughter that she would not be leaving with her father. School authorities wanted Dinardo to leave the property but he refused.

Then Dinardo was advised numerous times to leave by Mentor Police officers, but he still refused.

Dinardo told police that he had a concealed carry permit and a handgun was seen in plain view on the center console inside the vehicle.

He then drove his vehicle to another area of the front parking lot near the school.

Upon seeing officers with weapons displayed and taking up tactical positions, school officials went into an immediate "lockdown" inside the school.

Police said Dinardo continued to disobey commands to get out of his vehicle.

He then drove slowly towards officers with his hands in the air. Officers were able to get him to stop the vehicle.

He was removed from the vehicle and taken into custody.

Dinardo was also found to have a large machete behind the driver's seat. Dinardo did not pick up the handgun during the incident.

Police said the lockdown by the school was completely appropriate for the situation.

Police said he will be charged  with two counts of illegal conveyance of a deadly weapon in a school safety zone, a felony; inducing panic, and criminal trespassing.

Cuyahoga Falls: Local man named acting CIA Director

CUYAHOGA FALLS -- In the wake of the Petraeus scandal, a new leader at the CIA has emerged. And he grew up in Northeast Ohio.

Michael Morell's family tells WKYC that he was always intelligent, but never imagined a career in our nation's intelligence. But since 1980, he's been working for the CIA, first as an economic analyst.

He's worked his way up the ladder, most recently serving as Deputy Director. He's been an eyewitness to history. He was traveling President George W. Bush on Sept. 11, 2001, as the president's briefer, and was in the Situation Room on May 1, 2011, as deputy CIA Director, when Navy SEALs killed Osama bin Laden.

He grew up in Cuyahoga Falls, attending St. Joseph's School as a boy. He graduated from Cuyahoga Falls High School in 1976, then attended the University of Akron.

His sister Karen Gaone says that he didn't know what he'd do with his economics degree until a professor recommended he apply for a job at the CIA. The next thing she knew, the family was helping him move to Virginia.

Gaone says while this wasn't in the plan, she isn't surprised by her brother's success. She says his work ethic, character, sense of duty and honor make him great at his job.

"He just works really hard to keep us all safe," said Gaone, who still lives in Cuyahoga Falls. "He views himself as just a public servant. He said, 'I'm not a celebrity. I'm just a public servant. I'm working very hard to keep us all safe, the whole nation.'"

When he's not busy with his all-consuming job, he tries to spend time with his family, a wife and three kids. He's also interested in mentoring the next generation of intelligence leaders.

Dr. Pat Nugent at St. Joseph's School says she's worked to make sure students know about Morell and his role in our country.

"Because in Cuyahoga Falls, it's not that big of a city," said Nugent. "To have such a famous graduate have such an important role, and yet know that we might have played a part in his foundation, that's just something we can be very very proud of."

What's the likelihood that Mike Morrell is named to the Director spot permanently? It's really all up to the President.

Multiple sources say he's on a short list of likely candidates. Some cite Morell's strong relationship with President Obama.

Former Acting CIA Director John McLaughlin told WKYC in an interview that Morell is an extremely qualified and very viable candidate for the position.

His family says Morell is there to do his job, and if that means being the next director of the CIA then he'll accept it.

"He would be okay no matter what happens. He would be okay if they wanted him to do it, he would be okay if they didn't," said Gaone.

"It would be very stressful and I'm concerned for him in that respect. It would be an awesome job for him to acquire, but I just want him to do what is happy for him and what's best for his family," she said.

"I am extremely proud of him, just the type of person he is," said Gaone.

Judge to join woman holding "idiot" sign Wednesday

CLEVELAND -- A Cleveland judge is not happy with how a woman carried out her unusual sentence.

Cleveland Municipal Court Judge Pinkey S. Carr recently sentenced Shena Hardin, of Cleveland, to two mornings of standing on a street corner holding a sign that says "only an idiot would drive on the sidewalk to avoid a school bus."

In September, Hardin was caught on cell phone video twice driving on the sidewalk because she did not want to stop for the school bus stopped in front of her.

The second time, police were waiting.

Carr was upset when she learned Hardin merely leaned on her sign for an hour Tuesday morning, while she chain-smoked, texted, and hopped back into a waiting car a couple times during the hour she was supposed to be clearly displaying the sign.

"If I wanted someone standing there for an hour texting and smoking cigarettes, I would have had that as part of her sentence," Carr told WKYC. "But, clearly, she's missing the point. Clearly, it's still a situation where she's defiant."

Related story: 'Sidewalk driver' wears 'idiot sign' as part of punishment

And so Judge Carr has made plans to personally supervise Shena Hardin on the corner of East 38th Street and Superior Avenue at 7:45 Wednesday morning.

"She's offended the public. She's offended this community and they have a right to know who this person is," Carr said, as she watched video of Hardin merely leaning on her sign Tuesday morning.

"I didn't expect her to say anything. I didn't expect her to chant. I didn't expect her to smile. I'm sure she's not pleased about it," Carr said.

"It's cold out there and it's snowing but at least hold the sign because that was part of your sentence. She needs to hold that sign up. It kind of defeats the purpose."

Hardin endured occasional taunts from passersby and a scolding from Lisa Kelley, the mother of a girl in a wheelchair who was trying to board the school bus when Hardin drove on the sidewalk and tore around the bus.

"She has no remorse for what she's done," a visibly upset Kelley said, as she observed Hardin. "She's been texting, smoking her cigarettes, talking on the cell phone. She don't care. This is no punishment for her."

Judge Carr said she has no objection to Hardin wearing a hat and sunglasses while she displays the "idiot" sign Wednesday morning, but insists the Cleveland woman hold it up clearly.

Former auditor Frank Russo reports to prison by Friday

Written By kolimtiga on Selasa, 13 November 2012 | 10.49

CLEVELAND -- By the end of the week, former Cuyahoga County Auditor Frank Russo will be serving time.

After cooperating with federal prosecutors in the ongoing county corruption investigation, it's his turn to face his sentence for his role in the crimes.

Each day behind bars, lights will come on at 5:30 a.m. at the Federal Correctional Institution in Loretto, Pennsylvania. It's where Frank Russo could wake up for the next 22 years of his life.

It costs taxpayers about $73 a day to keep him there.
Along with 1,300 other prisoners, he will report to breakfast at 6 a.m. and make his bed by 7:30. Then it's time for work.

Russo, working with his friend and sidekick ex-Cuyahoga County Commissioner Jimmy Dimora, took bribes and cheated on his taxes, pleading guilty to 21 corruption crimes.

In the nearly two years since his sentencing, Russo's been volunteering at a local soup kitchen. His new menu might be familiar.

The Federal Bureau of Prisons Certified Menu shows that for lunch Saturday, Russo could enjoy a package of sardines, chips, vegetable juice, bread and an apple.

Dinner? PB and J.

Any extras will have to come from the commissary, but he's likely to get a turkey dinner next week. The bureau of prisons does offer holiday meals.

Other creature comforts are limited.

Russo can get up to four visits a month, immediate family only.
He'll be able to make monitored phone calls and watch TV during waking hours. There's absolutely no smoking in prison, something Russo's been known to do on his nights on the town.

Now he'll face lights out by ten until midnight.

While prosecutors will cut him slack for cooperation, there's no word on when he'll be outside again.

Loretto has housed other infamous company, including former Connecticut Gov. John G. Rowland and actress Anne Hathway's ex- Raffaello Follieri.

Russo apologized for his actions following a hearing last month, saying he'd like to take a positive step forward in the future.

Russo still has to testify in the scheduled February trial of attorney Anthony Calabrese III.

Anthony Sowell's 'artwork' for sale online

CLEVELAND -- Drawings by Cleveland's most notorious serial killer are being offered for sale online.

Several items bearing Anthony Sowell's signature, picture, and thumb print are listed on a so-called "murderabilia" website which a few years ago sold bags of soil removed from Sowell's yard on Imperial Avenue.

"We are simply the messenger," said Eric Gein of Serial Killers Ink, the website which is selling Sowell's drawings, and which today published a letter from Sowell, in which the killer of 11 women defended his right to speak.

"I give out artwork to you and others all the time," Sowell wrote to Gein, in a four-page letter posted on the website. "I'm not breaking any laws and I will keep sending out letters, artwork, and photos. I'm not being paid for them."

The drawings sell for as much as $225. One of them features a grim reaper figure above 11 tombstones, some of which carry the letters RIP, while others have crosses.

"We have nothing to hide," Gein said in an emailed statement, also defending his right to sell such items as long as Sowell makes no money from them himself.

Ohio law restricts inmates such as Sowell from making a profit on sales.

In a letter posted today on the website Serial Killers Ink, Sowell writes, "Hello people of Cleveland. I know that you may not like me but this person is now your County prosecutor."

Sowell railed against newly elected Tim McGinty in the letter He also issued this statement about the sale of items by inmates and their ability to issue statements or publish letters.

"A convicted murder should not have access to computers, websites, or e-mail. Penitentiaries should severely restrict and monitor all access to the outside world.

"Any cash the murders receive should be confiscated to pay restitution to the victim's families and the tax payers for the court costs, fines and cost of attorneys. No convicted murder should be permitted to profit from their crimes. All accounts should be confiscated until these debts are paid in full."

Gein said that his website "will continue to offer Tony a public forum where he is free to voice his opinions without spin or damnation if he so desires."

Smoke alarms: Not all wake 'deep-sleeping' children

PAINESVILLE TOWNSHIP -- There are few times when seconds matter more than in a house fire.

But experts say only about one in three children can successfully escape from a house fire on their own.

According to the National Fire Protection Association, two-thirds of Americans have a fire escape plan, but only one-third have practiced that plan.

Firefighters and doctors say the type of alarm a child hears can make a difference.

Researchers at the Children's Hospital of Columbus (now Nationwide Children's Hospital) examined the issue.

Smoke detector comparison study

24 children ages 6 to 12 were observed during deep sleep (stage 4 sleep). The testers set off a high-decibel beeping smoke alarm.

Just 58 percent of the children woke up to the nois, and an even lower number correctly performed a fire escape drill.

Doctors are still researching the reasons why children do not respond to noise while sleeping the same way adults do.

For firefighters, the concern is what can happen in the time it takes children to wake up and escape a house fire -- if they wake up at all.

"It's the smoke that's the killer. It's not the fire. It's the gasses in the smoke that are killer. So the importance of the smoke detector is early warning," says Painesville Township Fire Chief Frank Whittaker.

Firefighters say a fire will quadruple in size as the time doubles.

Researchers then tested voice-recorded smoke alarms on the same group of children.

These alarms allow parents to record a specific message for each child that plays at a loud decibel intermittent with beeping noise.

For example, Channel 3 News producer Jon Adkins tested the voice-recorded alarms at his home when his three children (ages 10 and under) were sleeping.

The alarm in our test is made by KidSmart, chosen for its positive reviews online. It retails from around $30-$40.

Suzanna Adkins recorded a personal message for each of her kids and the smoke alarms were set off in each of the children's rooms:

"Morgan, wake up! It's Mommy. There's a fire in the house! You'll be okay, Morgan. Remember what we practiced. Get out of your room, go down the stairs, and meet me outside!"

The Adkins' 7-year-old daughter, Morgan, woke up and performed the fire escape drill to the voice-recorded alarm, whereas the standard beeping alarm did not wake her up at all.

Her response is in line with what researchers found:

In the hospital study, 96 percent of the children not only woke up to the voice-recorded alarm, they correctly performed an escape drill.

"It's a reinforcement of a lesson. How can you say that won't work? Anything that improves the chances of getting out is good," Chief Whittaker said, of the product.

For more information on smoke alarm safety and the Columbus study, click on the links on this page.

Parents should be aware: the KidSmart alarm is battery operated, and is not linked to a household alarm system.

It is an individual unite with batteries that must be regularly tested and changed, according to fire department recommendations.
