CEO Eric Gordon said he realizes schools district-wide are likely to have lower attendance than normal Wednesday as many homes throughout the city are still without power.

He made the decision to reopen schools that have power not only in the interest of restoring learning, but also in consideration of the students and families CMSD serves.

"We anticipate that, in light of the circumstances, many families will be grateful that we are open and able to provide a safe, caring place for their children as parents return to work," said Gordon.

"By opening the majority of our schools, even as we restore power in 23 of our facilities, our families remain in charge of their own decisions and can choose to keep their children home or send them to school as best meets their needs and circumstances."

People step up, show their true colors, their toughness, and all come together.

There are still so many people in harm's way.....

Cleveland: Boats sink, are damaged by superstorm

CLEVELAND -- Superstorm Sandy hit the boating community in the Cleveland area hard. The U.S. Coast Guard tells WKYC a total of 36 vessels sank and another 19 broke away from their docks because of the storm. 

In addition to that, another two boats are unaccounted for and many more sustained damage. Thirty of the vessels that sank went under at the Edgewater Marina in Edgewater Park. 

Scott Kroehle's boat was a just one of those boats.

"It's rough. I got it a couple months ago, actually, and I've been riding it every chance I had," said Kroehle.

All that's visible of his boat is the mast.  Even still, the hurricane Katrina survivor was optimistic.

"I saw people lose everything, their lives... it [his boat] was just for fun." 

For Captain Vitas Kijauskas, time spent on Lake Erie is anything but a leisurely pastime. It's how he earns his living. Monday night he almost lost it all, at the force of a storm, few say they've ever seen before.

"I tied the boats up as good as I can over there. I just thought it was an endless cause," said Kijauskas, who rode the storm out at the wall that he used to tie his two head boats to. 

"It was nothing but might to hold those boats up to the wall."

Both vessels docked at Wildwood made it through the storm.  Back at Edgewater Marina, boat owners were not permitted to access their boats after the storm kicked up for safety reasons. 

"It would've been so easy to have been swept overboard. We were very fortunate that nobody, we didn't lose anybody in the water," said Michael Hill.

No word yet on how much the storm has cost boaters in damage.

Soggy Sunday doesn't stop Browns tailgaters

CLEVELAND -- The Sunday sea of orange and brown wasn't washed away by Mother Nature's wicked mood.

Chilly winds and constant rain didn't scare football fans away because they continued the tailgating tradition in the muni lot before the Browns battled the Chargers on Oct. 28, 2012.

The grills were still fired up and cornhole was the game of choice for those not bothered by the soggy conditions.

Two newlyweds even spent part of their honeymoon tailgating.

Many others huddled around fires and under tents to celebrate their favorite sport.

There's just no stopping Browns fans.

Browns edge Chargers 7-6 in rough weather

CLEVELAND -- Rookie Trent Richardson rushed for 122 yards and scored a touchdown, leading the Cleveland Browns to a soggy, wind-whipped 7-6 win over the San Diego Chargers on Sunday.

Richardson, pulled last week at Indianapolis when he was ineffective because of a rib injury, carried 24 times as the Browns (2-6) won their second straight game at home - and first for new owner Jimmy Haslam.

Richardson scored on a 26-yard run in the first quarter and the Browns were able to hang on despite not generating much offense in blustery, rainy conditions. The Chargers (3-4) dropped their third straight.

San Diego had a final chance, but quarterback Philip Rivers' pass was batted away by Browns cornerback Buster Skrine with 1:24 left. Rivers finished 18 of 34 for 154 yards but had a potential touchdown pass dropped by Robert Meachem in the third quarter.

WKYC teams up with community to Make A Difference

A total of 748 volunteers donated 1,671 hours of their time on Saturday at 23 different locations across Northeast Ohio in an effort to make our community a better place.

Volunteers included WKYC staff members and viewers from across our area.

National Make a Difference Day was started by Gannett-owned USA Weekend 20 years ago. This year WKYC joined the company wide effort, encouraging staff and viewers to join in on this national day of giving back.

Five winners even received prizes for their participation. The winners are listed below:

  • Nancy Dempsey
  • Sonya Pryor-Jones

Main sites included The Cleveland Foodbank, the Akron Regional Foodbank, The Boys & Girls Clubs of Cleveland, The Salvation Army and Coats for Kids. Volunteers were found at other locations from the Carl & Louis Stokes Academy to the Berea Animal Rescue Fund to libraries, museums and Metroparks across the area.

Jo-Ann Fabric and Craft Stores generously donated hundreds of craft supplies to five Boys and Girls Clubs in Cleveland for volunteers on Make a Difference Day - Oct. 27th. Over 360 youth across the city will be decorating pictures frames with foamie décor and glitter, personalizing their own canvas tote bags with festive fall shapes and making beaded bracelets. Over 30 boxes of supplies were delivered and soon youth ages 6-12 at the Boys and Girls Club will be expressing their creativity thanks to Jo-Ann!

There was an impressive showing of 300 plus volunteers in Nordonia where they turned Make A Difference Day into an day of service for their school district, volunteering at 10 different sites in the community.

If you didn't have a chance to volunteer today, there are volunteer opportunities just about every day of the year.

The Volunteer Center at BVU is Greater Cleveland's resource for recruiting, developing, and organizing volunteers. Since 1993, BVU has been linking volunteers to opportunities that address such issues as homelessness, the environment, crisis support, youth and families, people living with disabilities, seniors and many more.

Cleveland Weather: What to watch

Sandy is a big deal.  We have never seen anything like it in modern meteorology.  It could have a catastrophic impact on the East Coast ... and it WILL have a direct impact here in northern Ohio next week.

But in the days leading up to the storm...this weekend...we have weather to keep an eye on.

Grab a beverage and get comfy...this is going to be a long discussion.

A cold front came through northern Ohio and will be "hung up" (stopping) east of us.  This will lock in the cool, breezy weather for the weekend.

Additionally, we have some upper air support coming our way that will allow for a prolonged rain tomorrow (Saturday) that could bring us half to more than 1" of rain.  Saturday's temps will be cool in the 40s and low 50s and it will be breezy.  

I know there are many communities with Trick-or-Treat this weekend, and it looks like the kids will need a good coat or rain poncho to go with their costumes.

Colder air begins to pour in on Sunday, and while we are probably going to have some lake enhanced showers, the question is whether they will be rain or snow.  I think most of Sunday during the day will feature rain, but a rain/snow mix will develop Sunday evening and continue Sunday night into Monday.  At times the change to only-snow could take place, and accumulations (especially in the higher terrain areas east of Cleveland) will be possible.  Right now, it just looks light...maybe a coating ... remember we have some warm ground!

Monday the rain showers will be scattered, but will continue and at times will be mixing with snow.  It will be chilly and breezy with temperatures in the middle 40s.  Monday night we'll have another threat for some accumulating snow in northern Ohio...maybe an inch or two (the air will be a little colder and would have a better chance to support the snow).

Then Tuesday Sandy comes calling.  The following is all based on the current forecast track for Hurricane Sandy...

Starting Monday night our wind will steadily pick up.  

Tuesday the storm will make landfall somewhere on the East Coast with the potential for catastrophic damage.  This is a very serious threat for places like Boston, New York City, Newark, Philadelphia, Baltimore, Washington DC and areas stretching inland.

Here, on Tuesday, we are going to have a VERY windy day and we are going to have a LOT of rain coming in.  Since the ground will be saturated and the winds will be high (sustained at 45+ with gusts to 60+), tree damage and power outages are looking to be a big concern for us.  We will be in the 40s.

It will be more of the same Wednesday...wind, rain and 40s.

Then Thursday it seems the storm will finally begin to weaken a bit.  We will still have rain and it will be breezy.

By Friday Sandy begins to move away to the northeast.  The rain becomes scattered, the breezes start to weaken and the temps come back toward 50.

Here is my "statement" today:

While we are NOT in the zone of possible direct landfall of Sandy with the potential for "catastrophic" damage... we will be feeling the affects of the storm IF the forecasts hold. High wind (not hurricane force) and heavy rain will cause problems here, possibly Tuesday, Wednesday and Thursday next week.  Power outages will be an issue.

Stay tuned ... don't panic.

Cleveland: President's remarks at Burke Lakefront

CLEVELAND -- President Barack Obama made a 19-minute speech after Air Force One landed on the tarmac at Burke Lakefront Airport in Cleveland.

Among his remarks:

Recap: Final Brown-Mandel debate

CINCINNATI -- Sen. Sherrod Brown and Republican challenger Josh Mandel debated for the third and final time Thursday night in Cincinnati.

Last week's debate in Columbus saw Mandel call Brown a liar and Brown describing Mandel as someone who could not be trusted. It's one of the costliest and most watched races in the country.

Here's a recap of  the final debate.

The last debate in Ohio's heated U.S. Senate race had the Democratic incumbent saying he will keep fighting for the middle class while the GOP challenger says Washington is broken and needs change.

Sen. Sherrod Brown and Ohio treasurer Josh Mandel debated live on NBC affiliates across Ohio.

Brown said Thursday night he had promised to work for the middle class and has done so with such actions as supporting the auto industry bailout.

Mandel has said he opposed the bailout; he says Brown is an example of why Washington isn't working.

In Columbus last week, Mandel looked into the camera and flatly called Brown "a liar," responding to a Brown campaign theme that Mandel can't be trusted.

Brown said that was "a pretty remarkable thing" for Mandel to say, calling the Republican the winner of "pants on fire" ratings in the fact-checking column of The Plain Dealer newspaper.

Mandel has depicted the 59-year-old veteran Democrat as a career Washington politician who uses "Washingtonspeak," while Brown has described his 35-year-old challenger as opportunistic and more concerned about his next office than doing the job he has.

They have split on the auto industry bailout backed by President Barack Obama's administration. Brown supported it and says it has saved thousands of Ohio jobs in auto-making plants and auto-related businesses.

Mandel said recently he opposed the bailout as unfair and fiscally irresponsible. The Obama campaign has been hammering Republican challenger Mitt Romney on the auto issue this week, in advertising and during rallies in Ohio. The state is considered pivotal in the presidential race, and also draws strong interest for the Senate race.

Republicans identified Brown, who unseated Mike DeWine in the 2006 election, as an early target in their bid to win control of the Senate, but polls have indicated Brown has been able to hang onto the lead in their race. It has drawn heavy outside ad spending on top of the some $30 million in spending by the two campaigns combined.

Mandel is a Marine veteran of Iraq who was a Cleveland-area city councilman and state legislator before being elected state treasurer two years ago.

Brown is a former Ohio secretary of state and state legislator elected to the U.S. House in 1992. Brown has championed the Obama health care overhaul, which Mandel calls "government-run health care" that he opposes. Brown supports abortion rights and gay marriage, both also opposed by Mandel.

Brown and Mandel have focused on their differences on issues from abortion to the auto industry bailout in the last debate of Ohio's heated race.

Brwn describes himself as a fighter for the middle class and steadfast supporter of women's choice on abortion.

Mandel says he would help economic growth with lower taxes and seek "common ground" on the divisive issue of abortion. He says he opposes abortion except to save a woman's life.

Their exchanges Thursday night weren't as vitriolic as their second debate last week, although peppered with sarcasm.

Mandel gave a somewhat conciliatory closing, praising Brown's wife and his own.

Brown thanked him in their debate televised around the state on NBC affiliates.

Hundreds of raucous supporters on both sides waved signs and chanted outside.

Investigator: Private ambulances put patients at risk

CLEVELAND -- Some private ambulances in Northeast Ohio lack basic life-saving equipment, like CPR masks and heart-starting defibrillators, while others are stocked with expired medications, a Channel 3 News investigation found.

The station also uncovered patients being put at risk by drivers who drank on the job, didn't know what they were doing, or didn't pay attention.

Private ambulances and ambulettes -- modified vehicles that transport wheelchaired patients -- transport more than 1.5 million people each year to the hospital, doctors appointments and other destinations.

One of those companies, Community Care, dispatched an ambulance to Rita Bush's home in Ashtabula after she passed out on the floor.

"It was two women -- they were pretty small -- lifting a 350-pound woman onto a tiny cot," said Bush.

The women, who radioed the company for help only to be joined by two older men, tried to take Bush down the front steps of her home, Bush said.

"I told them, 'Don't drop me, don't drop me, you're going to drop me,'" Bush said. "All I remember is waking up to the cot going down on the ground. I went from the top step to the bottom step. My head was hanging to the side."

Bush said the paramedics ignored protocol in lifting her and refused to call the local fire department for assistance, even though she told them to do so.

Channel 3 News reviewed state records on 40 private ambulance and ambulette companies in Northeast Ohio and found they have been slapped with 284 violations since 2010 for everything from expired drugs to broken equipment.

The station also uncovered cases like Bush's where patients were put at risk.

"I've seen some screwed up things," one driver told the Investigator Tom Meyer, like the time he saw another driver leave a patient in a wheelchair in the middle of a busy street and walk away. "I've seen someone (in a wheelchair) fall off the ramp (of an ambulette). I don't know how that happened."

A family of a suicidal patient sued American Medical Response, a national chain that operates in Northeast Ohio, after the patient escaped from a moving ambulance and jumped from a highway overpass into oncoming traffic. 

In the lawsuit, which was later dismissed following a confidential settlement, the family said the drivers left the patient unstrapped and alone -- even though they knew she was a threat to kill herself.

Poor patient care is only part of the problem.

Our investigation found ambulance companies with missing blood pressure cuffs and heart-starting defibrillators.

Ambulances and ambulettes were cited for faulty brakes and tires, while some drivers lacked required medical training, background checks and  driver's licenses.

American Medical Response was cited the most -- 43 times -- with violations that included a broken heart monitor, missing CPR mask and expired drugs.

American Medical Response says that all violations have been corrected, that they're in good standing with the the state, and their license has been renewed. 

A former employee of Ohio Ambulance, which had 20 violations, said the company routinely overlooked major infractions.

She said that some ambulette drivers would be on the road with patients, either drinking and driving or still drunk from the previous night. "Management knew" but didn't do anything about it, the former employee said.

Jerry Dozier, general manager of Ohio Ambulance, said, "We've never actually caught people drinking on the job, but we have sent home employees who were suspected of drinking, and suspended or terminated them"

The former employee said Ohio Ambulance also kept dangerous vehicles on the streets.

She routinely drove vehicles that smelled so strongly of gas fumes that patients would become ill. She also drove vehicles with wheelchair lifts that leaked hydraulic fluid on the floor, putting patients at risk. And, she drove vehicles with bad brakes.

"You would call dispatch...and they'll tell you, 'See if you can do one more patient,'" the former employee said.

The general manager denied the allegation. "Anytime we have any complaint on a vehicle we take it very seriously," said Dozier. "We have full-time mechanics that work here."

The state Ohio Medical Transportation Board, which conducts regular inspections of private ambulance and ambulette companies, has prosecuted 20 companies since 2005 -- but none in the past 2 years.

A review of the actions also shows that every time the state board suspended a company's license, it still allowed the company to operate.

The Ohio Medical Transportation Board does not regulate patient care -- they leave that up to the companies and their medical directors.

And if a patient is injured, state law says that the patient may only sue if the injury is the result of willful and deliberate misconduct.

The law leaves many injured patients like Rita Bush, who still has back pain, uncompensated and angry.

"It's ridiculous," said Bush. "If it happens, it happens. You did it. It's your problem. It's your responsibility."

CLEVELAND -- Several roads and freeways around Burke Lakefront Airport in Cleveland will be closed/restricted Thursday (Oct. 25) between 5 p.m. and 10 p.m.

From 8 p.m. to 10 p.m., the following will be CLOSED:

  • Rt. 2 eastbound at E. 9th Street
  • Rt. 2 westbound at the I- 90, Rt. 2 split (Dead Man's Curve)
  • I-90 eastbound at the entrance ramp to Rt. 2 westbound
  • W. 3rd Street entrance ramp to Rt. 2 eastbound

Local access only between 5 p.m. and 10 p.m. for the following:

  • N. Marginal Road from E. 9th Street to E. 55th Street (Local traffic must enter the North Marginal from E. 55th Street)
  • Rt. 2 eastbound traffic will be diverted to Superior and to E. 26th Street where drivers will have access to I-71, I-77 and back to Rt. 2 eastbound.

Traffic controllers and police will be on hand to direct drivers during the closures.

Woman punched by RTA bus driver speaks out

CLEVELAND -- It was the uppercut that went viral on the Internet. An RTA driver hauled off and punched a woman in the face.

Fellow drivers support him, saying he did what he had to do. Charges have been filed against the woman involved in the fight and now, she's speaking out.

"It hurts in my heart, but like I said, I'm a very strong woman."

Shi'dea Lane sits next to her attorney, physically healed, but emotionally bruised. Quiet and almost shy, a very different person than the over one million people across the world saw in the YouTube video.

What the video doesn't show is what led up to this. Lane says she had forgotten her book bag and told the driver she was searching her pockets for money.

"When I first got on the bus, he said to me in his words, 'Ho, you ain't got no money' ... he just kept disrespecting me and I was standing up for myself."

Lane says she never spit on the RTA bus driver Artis Hughes.

Lane says she is a victim of domestic violence and decided to stand up for herself. She admits to throwing verbal punches but never saw the uppercut coming.

"I never expected him to physically attack me."

Cleveland Weather: Running for a record

Temperatures hung in the upper 60s to near 70 for much of the day Tuesday, but once the sun breaks out on Wednesday expect the temps to start to rise.

This time of year, highs average out to be around 60 degrees.  Record highs vary, but are right around 80 from various years.

For Wednesday, we'll have some clouds and showers to start, but then the sun shines and the mercury will be on the move.  Mid 70s will be the rule, but some upper 70s aren't out of question.

Then Thursday we have the combination of a good, warm wind, and plenty of sunshine which will help to push highs toward 80 (and possibly above).  Thursday's record high is 80 set in 1963...we'll be right there.

Then sometime on Friday (some models say midday/afternoon...others say Friday night and even early Saturday) a cold front will come through that will shove us back to October reality.

The weekend will be feeling VERY different.  

Not only that, but we will continue to watch what will happen to Tropical Storm Sandy.  The storm is expected to move from the Caribbean northward toward the Bahamas.  After Friday the big question in will the storm move east into the open Atlantic (and make little impact on the US) or will it move along the East Coast and make for some major problems.  Only time will tell.  Stay tuned...

Fact Check: Missteps in Monday's debate

WASHINGTON -- Voters didn't always get the straight goods when President Barack Obama and Republican Mitt Romney made their case for foreign policy and national security leadership Monday night before their last super-sized audience of the campaign.

A few of their detours into domestic issues were problematic too.

A look at some of their statements and how they compare with the facts:

ROMNEY on Syria: "What I'm afraid of is we've watched over the past year or so, first the president saying, 'Well, we'll let the U.N. deal with it.' And Assad - excuse me, Kofi Annan - came in and said we're going to try to have a cease-fire. That didn't work. Then it went to the Russians and said, 'Let's see if you can do something.' We should be playing the leadership role there." OBAMA: "We are playing the leadership role."

THE FACTS: Under Obama, the United States has taken a lead in trying to organize Syria's splintered opposition, even if the U.S. isn't interested in military intervention or providing direct arms support to the rebels. The administration has organized dozens of meetings in Turkey and the Middle East aimed at rallying Syria's political groups and rebel formations to agree on a common vision for a democratic future after Syrian President Bashar Assad is defeated. And Secretary of State Hillary Rodham Clinton brought dozens of nations together as part of the Friends of Syria group to combine aid efforts to Syria's opposition and help it win the support of as many as Syrians as possible. The U.S. also is involved in vetting recipients of military aid from America's Arab allies like Saudi Arabia and Qatar. Romney is partly right in pointing out Obama's failure to win U.N. support for international action in Syria. But the Friends of Syria group has helped bring in hundreds of millions of dollars in humanitarian aid and other forms of assistance to Syrian civilians and the political opposition. In trying to describe the strategic importance of seeing Assad defeated, Romney stumbled in saying Syria was Iran's "route to the sea." Iran has a large southern coastline with access to the Persian Gulf and the Gulf of Oman. It has no land border with Syria.

ROMNEY: Said that when he was Massachusetts governor, high-school students who graduated in the top quarter "got a four-year, tuition-free ride at any Massachusetts public institution of higher learning."

OBAMA: "That happened before you came into office." ROMNEY: "That was actually mine, actually, Mr. President. You got that fact wrong."

THE FACTS: Romney was right. The John and Abigail Adams scholarship program began in 2004 when he was governor.

ROMNEY: "In the 2000 debates, there was no mention of terrorism."

THE FACTS: There was passing mention of terrorism in the 2000 debates. In the Oct. 17, 2000, debate between Democrat Al Gore and Republican George W. Bush, Gore talked about his work in Congress to "deal with the problems of terrorism and these new weapons of mass destruction." And in the vice presidential debate, Democrat Joe Lieberman defended the Clinton administration's record of preparing the armed forces to "meet the threats of the new generation of tomorrow, of weapons of mass destruction, of ballistic missiles, terrorism, cyber warfare." Romney's larger point, that the U.S. did not anticipate anything on the scale of terrorist threat that existed, is supported by the light attention paid to the subject in the debates.

OBAMA: "What I would not have had done was left 10,000 troops in Iraq that would tie us down. And that certainly would not help us in the Middle East."

THE FACTS: Obama was suggesting that he had never favored keeping U.S. troops in Iraq beyond the December 2011 withdrawal deadline that the Bush administration had negotiated with the Iraqi government. Actually, the Obama administration tried for many months to win Iraqi agreement to keeping several thousand American troops there beyond 2011 to continue training and advising the Iraqi armed forces. The talks broke down over a disagreement on legal immunity for U.S. troops.

Romney-Obama third debate re-cap of major issues

Republican Mitt Romney says he praises rival President Barack Obama for ordering the raid that killed al-Qaeda leader Osama bin Laden, but adds that the United States "can't kill our way out of this mess" of religious extremism.

Romney opened Monday's third and final presidential debate by criticizing Obama's policies toward Islamic extremism. He says that Obama missed an opportunity during the Arab Spring and says that Obama has not done enough to block Iran from building a nuclear weapon.

Obama says Romney has not been in a position to execute foreign policy, but adds that his positions to this point have "been all over the map."

Romney says his strategy "is pretty straight forward: go after the bad guys."

President Barack Obama and Republican Mitt Romney say they are both opposed to sending U.S. troops to Syria to end the violence there. Obama says that while attacks by government forces against Syrian citizens is heartbreaking, getting the U.S. "entangled militarily" would be a serious step.

Romney essentially agreed, saying he doesn't want the U.S. military involved in Syria. Romney said the United States should be playing a leadership role in identifying responsible opposition groups in Syria and making sure they have the arms they need to fight President Bashar Assad's regime.

Obama says the U.S. is working with allies in the region to learn more about the opposition. But he says giving heavy weapons to those groups is not "a simple proposition."

President Barack Obama and Republican Mitt Romney outlined different visions of the U.S. role in the world. Romney said the U.S. has the "responsibility and privilege" to promote peace throughout the world. But he said domestic issues like the sluggish economy and debt had weakened U.S. leadership.

Romney said he would not cut military spending as president and would work to strengthen international alliances. Obama said the U.S. was the "one indispensable nation" in the world and is stronger now than when he took office.

He said the U.S. should rebuild its economy by keeping jobs in the country rather than shipping them overseas.

President Barack Obama took an aggressive posture toward rival Mitt Romney in Monday's debate, at one point saying the Republican's policy proposals are so outdated "the 1980s are now calling to ask for their foreign policy back."

The two sparred early in the debate moderated by CBS News anchor Bob Schieffer.

After Romney voiced concerns about the persistent threat of al-Qaida in the Middle East, Obama noted Romney had once called Russia the nation's gravest geopolitical threat. Obama said Romney's policy positions were rooted in the 1980s and his views on social issues are rooted in the 1950s.

Romney said he wouldn't have "rose-colored glasses" toward Russian leader Vladimir Putin and chided Obama for suggesting he would have greater flexibility toward Russia after the election.

President Barack Obama and Republican Mitt Romney shifted their debate on foreign policy toward domestic issues that are foremost on voters' minds. Obama turned questions during Monday's third and final debate around and made them about jobs and the economy.

Romney, too, pivoted from foreign policy questions to his five-point domestic agenda for jobs and the economy. At one point, debate moderator Bob Schieffer seemed exasperated. "Let me get back to foreign policy," he pleaded.

Obama answered one foreign policy question by talking about his education initiatives and criticized Romney's tenure as Massachusetts governor. Romney, too, detoured stateside. When asked about America's role in the world, he shifted the talk to college students who are graduating without jobs.

President Barack Obama says the United States will stand with Israel if it's attacked. Obama said Iran will not get a nuclear weapon "as long as I'm president."

Republican challenger Mitt Romney says he'd push for diplomatic isolation of the country. He says Iranian President Mahmoud Ahmadinejad's rhetoric fans genocide and should be prosecuted under international law.

Obama says tough U.S. sanctions have "crippled" Iran's economy to the point that it's a shambles. The president says Iran is ultimately a threat to American national security and is a state sponsor of terrorism.

President Barack Obama says his military spending is "driven by strategy" not by politics. The president rejected criticism from Republican Mitt Romney, who says Obama wants to cut the military by $1 trillion.

Obama disputed that figure, but said spending needs to be based on the capabilities required by the military, not just budgets. Obama accused Romney of calling for increases in military spending that the Pentagon doesn't want.

Romney says he would boost the number of naval ships because the U.S. fleet is the smallest since 1917. The president shot back, saying that was because technology has changed the nature of the military. Romney said he would pay for increases in military spending by getting rid of Obama's health care overhaul and other programs he deems unnecessary.

President Barack Obama says published reports that the United States and Iran are planning to meet one-on-one after the election are "not true."

Obama says the United States will keep Iran from getting a nuclear weapon, but he will not engage in negotiations that go nowhere. Obama adds that "the clock is ticking."

On Saturday, the White House said it is prepared to talk one-on-one with Iran to find a diplomatic settlement to the impasse over Tehran's reported pursuit of nuclear weapons, but there's no agreement now to meet.

The New York Times reported that the U.S. and Iran have agreed in principle to negotiations. The White House denied that any such agreement had been reached.

President Barack Obama pushed back on rival Mitt Romney's suggestion that the president has apologized for the United States on the world stage. Obama called the accusation the "biggest whopper" of the campaign.

Obama said he would not allow Iran to develop a nuclear weapon and had coordinated an international coalition to impose economic sanctions on Tehran.

Obama said that under his presidency, the world is more united and Iran has been weakened. Romney insisted Obama had apologized for the U.S., noting the president had given a speech in Egypt early in his term saying America had been "derisive" and at times had dictated to other nations.

Romney is backing President Barack Obama's plan to pull American troops out of Afghanistan by the end of 2014. Romney says the Afghan troop surge that Obama ordered has been successful and a training program for Afghan forces is on track.

As a result, he says the U.S. will be able to make a transition at the end of 2014 and make sure U.S. troops come home. The Republican nominee has previously criticized Obama for setting a timeline for ending the war.

Obama tripled the number of U.S. troops in Afghanistan upon taking office. He has said the U.S. will maintain a civilian presence in Afghanistan after its military operations end.

Canton: Student growing hair for 'Locks of Love' suspended

CANTON --  Canton South High School Junior Zachery Aufderheide is close to reaching a personal goal. "If I could just give the chance for one kid to have a normal life, then I'm just going to go for it," Aufderheide said.

He's about an inch away from donating a healthy head of hair to Locks for Love.

On Monday, Zachary was called to the principal's office for violating the school's code.

Locks of Love uses donated hair of a certain length to create hairpieces for kids struggling with hair loss, due to cancer and other illnesses.

The only thing standing in the way of Zach's goal to donate to the organization for a second time is the school's dress code. The code maintains that male students hair must be kept above the shirt collar.

"What he's doing is against board policy. The decision on this one, tough as it was, was to follow the board policies written," said School Board President, John Martin.

Zach says that, three weeks into the new school year, he was told he would have to cut it. He says he explained to staff and the Canton Local Schools' board back in September what he planned to do with the hair.

"If it's already this close, if I cut it now, it would just be a waste of time," Zachary said.

According to Aufderheide, they seemed sympathetic, but later decided to uphold the dress code requiring him to cut his hair or face disciplinary action.

Zachary's mother says she received a phone call from the principal Monday, stating her son would serve two days of in-school suspension starting Tuesday.   

"It's just hair. I know it's in the [school handbook] contract. I know it's in the school policy. But it is just hair. What harm can hair do?" Zachary said.

Luck helps Colts run through Browns 17-13

INDIANAPOLIS (AP) - Andrew Luck became the first Colts quarterback to run for two touchdowns in a game since 1988, leading Indianapolis past Cleveland 17-13 on Sunday.

Indy (3-3) has already won one more game than it did in 2011.

Brandon Weeden threw for 247 yards and two touchdowns, but Trent Richardson, who tried to play through a rib cartilage injury, sat out the second half after running eight times for 8 yards in the first half. The Browns (1-6) have lost 11 straight road games.

Luck scored on runs of 3 and 5 yards in the first half.

Weeden threw a 14-yard TD pass to Greg Little in the second quarter, and a 33-yard TD pass to Josh Gordon in the third quarter.

Adam Vinatieri added a 38-yard field goal for Indy.

Chagrin Falls: Mitt Romney 'flash mob' hits town

CHAGRIN FALLS -- The real Mitt Romney wasn't visiting here but there were hundreds of "Mitt Romneys" in the streets of downtown.

Just about 2:15 p.m., it was a blast of an air horn that brought the 222 masked members of the "Mitt Romney Flash Mob" to Triangle Park in the middle of downtown.

Where there had been just a few Sunday strollers moments earlier, suddenly there were more than 200 "Mitt Romneys" flooding into the park.

They converged on the park from all corners of the streets leading into downtown Chagrin Falls for the mob, all wearing Mitt Romney masks.

Republican Party of Cuyahoga County Chairman Rob Frost was the "master of the mob," himself in a Romney mask.

The "Mitt Mob" was coordinated by the Chagrin Falls Republican Party. Its local office is across from the park on North Franklin Street.

Also in attendance were local and county Republican officeholders and candidates, including District 6 Cuyahoga County Councilman Jack Schron, of neighboring Moreland Hills.

Cleveland Weather: Indian summer

When a stretch of warm weather sets up for several days after we've had a killing frost, it is referred to as Indian Summer.

We will be having our Indian Summer this week as a very mild weather pattern brings us temperatures in the 70s.

But remember, with weather often an extreme in one direction can bring about an extreme in the other direction.  So, just about the time we are really getting used to 70s in late October, reality swings in on a major cold front.  

The exact timing will become clearer this week as it gets closer, but next weekend we are going to have just such a front passing through.  It appears we'll be wrapping up the month of October on a very, very different note.  

Stay tuned.

Maple Heights: Roads reopen after apartment fire

MAPLE HEIGHTS -- Roads have reopened after an apartment fire caused several closings Saturday evening.  

According to Maple Heights police, I-480 Eastbound ramp at the Warrensville Center Road exit was closed as a result of the fire.

The fire began shortly after 5 p.m. on Warrensville Center Road in a three-story apartment building.

Several neighboring fire departments responded to the scene, including Bedford, Bedford Heights and Garfield Heights.

Preliminary investigations reveal that the fire happened as a result of a heating unit.

At the time of the fire, eleven out of twelve apartments were occupied.

All of the occupants made it out safely, but several families were displaced and are being assisted by the Red Cross.

MENTOR -- Police Chief Daniel Llewellyn confirmed that the "unflattering" YouTube video of a Browns fan sticking his head in a 5-gallon bucket of urine for $450 while tailgating before last week's Browns game was an off-duty Mentor police officer.

It was off-duty officer Phil Croucher, a 16-year veteran of the department. Llewellyn said Croucher was placed on leave pending a medical evaluation. That evaluation happened Friday and Croucher was "cleared and has returned to duty."

Llewellyn described Croucher as "an exceptional" officer, saying he has at least 14 documents highlighting his excellent work, including some from Secret Service and the FBI.

Llewellyn said he was "disappointed" by Croucher's poor judgment and the department is working now to develop a clear policy for how officers should act, even when off-duty.

Llewellyn said he expects better from his officers, even when off-duty.

Cleveland Weather: Holding out hope

October in northern Ohio is known for having some pretty big swings in the weather.  

Often we'll have nice warm temperatures followed by a quick hit of cold air and then get to back to warmth.  

As the month progresses, the warm periods get shorter and the cold air lasts longer ... and then before you know it, November is here.

Well, it looks like we have a quick hit of cool air that will be here for Saturday, but Sunday we'll start warming up and we are expecting the 70s to be here for much of next week.

Of course, there is always the next batch of cold air in the forecast and it looks like it will arrive before Halloween.

Akron: Jury hears Craigslist killings audio tapes

AKRON -- Recorded interviews with accused Craigslist killer Brogan Rafferty were played for an Akron jury Thursday.

Rafferty, 17, is charged with multiple counts of aggravated murder, kidnapping, robbery, and theft in the executions of three men in southern Ohio in 2011.

Prosecutor's allege Rafferty and accused accomplice Richard Beasley lured the men to Noble County with the promise of a nonexistent caretaker's job, which was advertised on Craigslist, and then robbed and killed them.

"I was to go help Beasley murder this man and hide the body for him," Rafferty told a Noble County Sheriff's detective in one of several taped interviews, when asked how the crimes began.

He was speaking of the killing of Ralph Geiger, of Akron, who was slain in August, 2011.

"Mister Beasley pulled a pistol out and with both hands he pointed it at the back of Mister Geiger's head," Rafferty is heard on the tape, very matter-of-factly.

"I closed my eyes and heard a gunshot.  I opened them and Mister Geiger was sitting in the creek bed."

"Did he seem to be dead?"the detective is heard asking.

"Yes, he was dead," Rafferty replied.

There were similar conversations about the killing of David Pauley in October, 2011, and about the murder of Tim Kern of Massillon in November of last year.

"I heard a pop," Rafferty said, "and Mr. Kern is on his knees holding the side of his head.  Beasley asked him if he was alright, and then he shot him again."

"The gentleman was still breathing so Beasley got the gun again, and I turned around because I didn't want to look, and he shot him again," Rafferty went on, calmly. 

"Four shots?" an investigator asks.

"Fourth shot," Rafferty answered.

"In the head?" the detective asked. 

"Between the eyes," said Rafferty.

The prosecution was close to resting its case against the 17-year-old, who they say was a willing participant in these so-called Craigslist killings.

Rafferty's attorneys say he was lured and pressured into taking part by Beasley, who was a long time family friends.

Must see: Icy plunge goes all wrong

There's a new video swirling around YouTube that's starting to gain popularity.

The footage shows a man in Germany trying to jump into an icy pool.

After taking a running start, the man curls up cannon-ball style in mid-air ready to splash into the frigid water.

What he didn't seem to realize is that the water was frozen solid.

His expected splash ended with a thud as he slams down hard and slides across the ice.

The moment led to an outburst of laughter from everybody present.

Students robbed of their school-issued iPads

CLEVELAND HEIGHTS -- Over a dozen students have reported being robbed while headed home from school. What did the thieves take? School-issued iPads.

Administrators say the incidents have all taken place over the past two weeks. At least 12 middle schools students were threatened and subsequently robbed while headed home.

"This news frustrates and outrages us," Superintendent Douglas Heuer said in a press release.

He went on to say that the students are easy targets because many people know the students carry iPads.

The Cleveland Heights-University Heights school district is working closely with area police departments to gather information about the robberies and locate suspects.

"We ask all residents to work with us to protect our students and make sure they receive the best education possible," said Heuer.

"Please help us ensure our students safety and that they have access to technology that will prepare them for the future."

Anyone with information related to the robberies are asked to call the school district or one of the police departments listed below.

Port: Cleaning up Lake Erie, Cuyahoga River

CLEVELAND -- There's no question that downtown Cleveland's shoreline is one of its best resources. But in some spots, the waterfront can look more like a garbage dump than a destination.

Today the Port of Cleveland announced a new program to clean up Lake Erie and the Cuyahoga River.

Channel 3's Jennifer Lindgren brings us the details.

There's a huge push underway to bring more people to the waterfront. Unfortunately, the city hasn't had a vessel dedicated to cleaning the harbor in many years. And it can get really dirty.

But two new boats, appropriately named Flotsam, and Jetsam, will soon be familiar sights on the water. They will be manned by a crew who knows how to make Cleveland look good.

If Glenn Hudson's blue coat looks familiar, it should be. He's one of the Downtown Cleveland Alliance Ambassadors now assigned to the new Harbor District.

It's a team of five people working 5 days a week during boating season, pulling just about everything out of the water.

Issue 107: School district cut what they could

CLEVELAND -- School leaders continued their efforts Wednesday to convince voters to pass Issue 107.

Currently, the Cleveland Metropolitan School District is at a crossroads. They believe the only way to guarantee and improve the quality of education for students is by passing the levy.

In the last two years, the district has cut over $114 million in expenses as565 teachers and staff were cut at the end of this year.

Federal and state funding has been cut by $134 million, including the stimulus funding.

"We don't want to cut any more teachers. We don't want to cut any more vital programs. We don't want to cut any more time our of a school day. We want to make sure that this school district has all the necessary tools that it has in place in order to succeed and not just survive," says Blaine Griffin, campaign manager for Right Plan Right Now.

A school levy has not passed in Cleveland for 16 years. If the levy passes, it will cost an average property owner 63 cents a day for four years.

Jimmy Haslam talks one-on-one with Jim Donovan

CHICAGO -- Following a whirlwind day where he was approved as the new owner of the Browns, Jimmy Haslam sat down for his only one-on-one interview with a Cleveland television station with Channel 3's Jim Donovan.

Haslam says becoming the owner of an NFL franchise is the realization of a long-held family dream.

NFL owners approved Haslam unanimously (32-0) in a vote during a meeting in Chicago.  Haslam received a thunderous ovation from his fellow-owners upon completion of the vote.

Haslam reached terms with Randy Lerner on a $1 billion deal to acquire the Browns back in August. 

Almost immediately following the vote came word of the first change for the organization.  Browns President Mike Holmgren will retire at season's end.  Haslam confirmed the details at a news conference Tuesday afternoon.  He described his dealings with Holmgren as very amicable. 

Former Eagles president, Joe Banner, will be the team's new CEO.   Banner will be introduced to the media in Berea on Wednesday.

Haslam has told Head Coach Pat Shurmur and his coaching staff that there will be no additional changes until the end of the season (if at all).

Haslam says he expects the transition of power to be seamless. 

Haslam says he will spend a great deal of time in Cleveland.  The family just purchased a home in Bratenahl.

He says he is excited to own such a storied franchise and to be part of the football-rich history of Northeast Ohio.

Haslam says he and his team will work hard to make the Browns a winning franchise, because he says the loyal fans here deserve it.

In taking over the team, Haslam thanked the Lerner family and called the ownership of the Browns a privilege.

Romney-Obama debate recap of major issues

President Barack Obama and Republican candidate Mitt Romney held their second of three debates at Hofstra University Tuesday night.

President Barack Obama is calling for reintroducing legislation to ban assault weapons. In discussing the issue at the presidential debate Tuesday night, Obama said weapons that were designed for soldiers at war don't belong on the street.

After the mass shooting in Colorado last summer, Obama aides said that the president supports the ban that expired in 2004. But Obama had not called for reinstating it until the debate. Republican candidate Mitt Romney repeated his opposition to banning assault weapons.

He had supported a ban as governor of Massachusetts. Romney says he's not in favor of new pieces of legislation on guns.

During the first debate, President Barack Obama never mentioned Mitt Romney's videotaped remarks that 47 percent of Americans are dependent on the government. This time it was his closing argument. Obama brought it up during the final question of the second debate, preventing Romney from answering.

Asked about public misperceptions of their candidacies, Romney said Obama's campaign tried to turn him into something he's not. Romney said - quote - "I care about 100 percent of the American people."

Obama responded that when Romney said "behind closed doors" that 47 percent of the country considered themselves victims, "think about who he was talking about." The president said that group included the elderly receiving Social Security, veterans, students and soldiers. He said: "If they succeed, I believe this country succeeds."

President Barack Obama says the responsibility for what happened at the U.S. consulate in Benghazi, Libya, falls to him and to no one else. Republican rival Mitt Romney says the president's team either didn't know all the details - or didn't tell the truth - about the death of four Americans there immediately after the attacks.

Obama and Romney met Tuesday for their second debate and sparred over the United States' response to the Sept. 11 attacks that killed America's ambassador of three others in Libya.

Obama says he wants to find out exactly what made possible those four deaths and calls Romney's response offensive and designed to score political points. Romney says the attacks represent the unraveling of Obama's foreign policy.

President Barack Obama and Mitt Romney are clashing over immigration, with Romney accusing Obama of failing to reform the immigration system during his first term. Romney says during the second presidential debate that the nation needs to stop illegal immigration, noting that 4 million people are trying to gain American citizenship legally.

He says he won't grant amnesty to people who come to the U.S. illegally. Obama says Romney has opposed the DREAM Act, a failed bill that would have provided a path to legal status for many young illegal immigrants.

He says Republicans in Congress have been unwilling to support comprehensive immigration reform and won't in the future with Romney as the "standard-bearer" of his party.

Mitt Romney says he differs from fellow Republican George W. Bush on energy policy, China and deficits. President Barack Obama says the biggest difference is that his GOP rival is more extreme on social issues than Bush.

A voter during Tuesday's town hall-style debate asked Romney how he was different than Bush, who left office deeply unpopular. Romney says that he would govern under different conditions that would allow him to make North America energy independent from Arab and Venezuelan oil. He also says he would crack down on China's currency manipulation and cut the deficit by increasing trade.

Obama was ready with a quick retort. He says Romney, unlike Bush, would cut funding to Planned Parenthood and that Romney would pursue a more stringent immigration policy than Bush did.

President Barack Obama is ticking through promises kept as having halted the economic slide but is pledging to go hard after those campaign pledges from 2008 that he has not met. In response at the presidential debate, Republican challenger Mitt Romney says Obama's unmet commitments have slowed the nation's economic recovery.

Obama listed small-business tax cuts, health care legislation and financial regulation as measures that helped stabilize the faltering economy. Romney says Obama chiefly has failed to meet employment targets.

Mitt Romney and Barack Obama both say their tax plans would benefit the middle class and spur job creation, and both are suggesting their opponent's plan would do the opposite. Romney says cutting tax rates across the board would spur job growth.

He says bringing rates down makes it easy for small businesses to keep more of their capital and hire more workers. But Obama, who supports raising tax rates on upper incomes, says Romney's proposed tax cuts and his calls for increased military spending would add trillions to the federal debt. Obama said to Romney, a former businessman, quote, "You wouldn't have taken such a sketchy deal." He says the American people shouldn't accept that deal either.

President Barack Obama and Mitt Romney have had a number of pointed exchanges during the second presidential debate, challenging each other on energy policy, pointing fingers and often speaking over one another. Without a desk between them, the candidates approached each other on stage at one point during a discussion on energy.

As Romney answered a question on gas prices and oil drilling, Obama stood up and moved toward his Republican challenger. Romney turned to the president's direction and they quarreled as they stood only a few feet apart.

At one point, Obama sharply rejected Romney's arguments, saying, "Not true, Gov. Romney."

When Obama interjected with his energy positions, Romney responded, "You'll get your chance ... I'm still speaking."

President Barack Obama and Mitt Romney are trying to appeal to female voters during the second presidential debate. Responding to a question about pay equity for women, Obama notes that the first piece of legislation he signed made it easier for women to seek the same pay as men for doing the same work.

Romney says that as governor of Massachusetts, his administration had a number of women in senior leadership positions. He says many women have suffered job losses and moved into poverty during Obama's tenure and that creating more jobs would help women.

The president questioned Romney's commitment to women's health care, pointing to the Republican's vow to eliminate funding for Planned Parenthood. He calls health care a "pocket book issue" for women and families.

Republican Mitt Romney criticized President Barack Obama's energies policies and said his rival "has not been Mr. Oil or Mr. Gas or Mr. Coal."

The pair sparred on energy policy as they met Tuesday for their second debate, a town hall-style meeting with undecided voters in New York. Obama says he wants U.S. energy policy to look ahead 20 or 30 years, and not just look at what lowers the cost right away.

The president says he's all for oil and natural gas, but he says he will not focus on them exclusively at the peril of renewable energy sources that could create thousands of jobs. Romney says Obama has fought new energy exploration on federal lands and that Americans have faced higher energy costs as a result.

President Barack Obama and Mitt Romney offered their jobs agenda at the start of the second presidential debate, responding to a college student concerned about finding a job after graduation.

Romney told the student that his question was one that's being asked by college student across the nation. He said his administration would try to make it easier for students to afford college and promote economic growth to help students. Romney says the nation faces more debt and fewer jobs. He says, quote, "I'm going to change that."

Obama says he would build upon the 5 million private sector jobs created during his first term, pushing for more manufacturing jobs. The president said his policies aimed to improve the education system and promote a variety of energy sources.

President Barack Obama is coming out swinging in the second presidential campaign debate, striking immediately at Republican Mitt Romney's opposition to the Democrat's handling of the auto industry bailout. Obama was seen as having missed opportunities to make gains in the first debate with Romney two weeks ago.

Romney was viewed as having won the debate. Obama also says Romney's plan is to let the oil companies write the energy policies.

At least twice Obama has accused Romney of being untruthful. And he's addressed Romney directly, unlike their first debate in Denver, when Obama primarily addressed the moderator, while Romney criticized the president.

Cleveland Weather: Whiplash

Autumn is known to bring us big changes in rapid fire fashion.  The past couple days and the upcoming week will be no exception to that rule.

Yesterday's balmy 70s are nothing but a memory today as temps held in the 50s through the afternoon.  We have a chilly night coming tonight and will stay cool for Tuesday, but Wednesday we'll pop right back above average.

By pop, I do mean a quick warmup into the 70s, followed by another drop into the 60s and then the 50s.

Of course, anytime you have these dramatic swings, we have wind that comes along as well.  High wind will be an issue again for Wednesday and Thursday as our next storms system blows through.  

If you are one of the many sufferers of migraines, arthritis, sinus issues or joint pain - be ready ... it is going to be an uncomfortable week.

Painesville: Judge sentences bartender's murderer to death

PAINESVILLE -- Judge Richard Collins Jr. has sentenced Joe Thomas, the man a jury found guilty of murdering Mentor-on-the-Lake bartender Annie McSween, to death.

On Oct. 4, the jury unanimously recommended the death penalty.

After several victim impact statements from the family and friends, Collins announced his sentence.

Thomas28, of Perry Township, will get an automatic appeal by state law.He was convicted on Sept. 28 of raping and murdering McSween, 49, of Mentor outside Mario's Lakeway Lounge in November 2010.

The jury found Thomas guilty on all 11 counts -- three counts of aggravated murder, three counts of kidnapping, two counts of aggravated robbery, rape and tampering with evidence.

This is only the second capital murder case in Lake County in nearly two decades. The last was the Jeffrey Lundgren mass murder trial, when now-Congressman Steve LaTourette was the Lake County prosecutor.

Streetsboro: Police pursue wrong-way driver on I-480

STREETSBORO --  Streetsboro police officers catch an I-480 wrongway driver who reached speeds of 80 mph eastbound in the westbound lanes in a black 2007 Lincoln.

Just after 3 a.m. Saturday, Streetsboro police received a call that a car was heading eastbound on I-480 in the westbound lanes, heading toward Streetsboro.

Two Streetsboro police officers responded to the area and found the Lincoln about a half-mile into Hudson on I-480. The officers turned on their emergency lights and sirens in an attempt to stop the vehicle.

The driver did not stop.

Officers pursued the Lincoln into Streetsboro and onto State Rte 14. where I-480 ends.

The pursuit was brought to an end on State Ret 14 near Shady Lake Drive when a Streetsboro cruiser pulled in front of the Lincoln and slowly brought the Lincoln to a stop.

Poliec say Ashley Stewart, 24, of Columbiana, Ohio, was the driver and only occupant of the Lincoln.

She was arrested and charged with failure to comply with the signal of a police officer -- a third degree felony -- and operating a vehicle under the influence.

Police say she refused to give a breath sample when asked.

Police noted that a Summit County Sheriff's deputy also assisted and his vehicle sustained minor damage when Stewart was removed from her car and it rolled into the deputy's car.

BIG WIN! Browns defeat Bengals 34-24, fans happy

CLEVELAND -- Rookie Brandon Weeden threw two touchdown passes and the Cleveland Browns snapped an 11-game losing streak that dated to last season, beating the Cincinnati Bengals 34-24 Sunday.

Cleveland had not won since Nov. 20, matching a franchise record for consecutive losses. But for the first time this season everything fell into place for the Browns (1-5).

Montario Hardesty, filling in for injured rookie Trent Richardson, scored on a 1-yard plunge and cornerback Sheldon Brown intercepted Andy Dalton and returned it 19 yards for a touchdown in the fourth quarter as the Browns outscored the Bengals (3-3) in the second half 27-10.

It was the first win in nine tries against an AFC North opponent for second-year Browns coach Pat Shurmur.

Bengals scored first on a 55-yard touchdown pass from Andy Dalton to Jermaine Gresham to give Cincinnati a 7-0 lead.

Bengals led 7-0 at the end of the first quarter.

Browns tied the game at 7 on a 71-yard touchdown pass from Brandon Weeden to Josh Gordon.

Bengals took a 14-7 lead on a 4-yard touchdown pass from Dalton to AJ Green. 

Bengals led 14-7 at halftime.

Phil Dawson cut the Bengals lead to 14-10 on a 41-yard field goal.

Dawson connected on his second field of the day from 38-yards to cut the Bengals lead to 14-13.

Bengals led 14-13 at the end of the third quarter.

Montario Hardesty scored on a 1-yard touchdown run to give the Browns a 20-14 lead.

Mike Nugent hit a 41-yard field goal to cut the Browns lead to 20-17.

Browns took a 27-17 lead on a 3-yard touchdown pass from Brandon Weeden to Ben Watson.

Sheldon Brown intercepted Andy Dalton and took it back 12-yards for the touchdown to give the Browns a 34-17 lead.

Andy Dalton threw a 57-yard touchdown pass to AJ Green to cut the Browns lead to 34-24.

Browns defeated the Bengals 34-24.

Cleveland: Fire crews battle blaze at Walgreens

CLEVELAND -- Cleveland Fire Department responded to a fire at a Walgreens on the city's east side Saturday evening. 

Walgreens is located at 6410 Broadway Avenue. The fire started just after 9:00 p.m. but soon developed into a Triple-two alarm blaze.

Employees reportedly smelled smoke in the store's cosmetic department but were unable to locate a fire. Some time after, employees saw flames in the department and called 911.

Workers helped customers evacuate the store while emergency crews were en route.

Police have assisted crews in shutting down Broadway Avenue until firefighters were able to get the fire under control. The area has now reopened.

The store sustained fire damage in the cosmetic area. Much of the store's merchandise will likely be a loss as the rest of the store sustained heavy smoke damage.

Fire crews are investigating to determine the cause of the fire.

Witness recalls RTA bus fight caught on camera

CLEVELAND -- An RTA bus driver has been suspended after cell phone video of a September 18th incident appeared online.

Artis Hughes, 59, is seen in the video punching an "unruly" customer. 

That customer is Shidea Lane, 25.  In the police report, Lane is listed as the suspect, while Hughes is listed as the victim. 

According to witness statements in the police report, Lane got on the bus saying she couldn't pay her fare. Hughes told Lane she needed to pay the fare or exit the bus.

Lane came up with the money for the fare and remained towards the front of the bus.

Passenger William Matthews says Hughes had asked Lane to step behind the yellow line.

The two began to argue as Lane, apparently ignored the driver's request.

"The bus wasn't that full.  There were seats, I don't know why she wouldn't pay and sit down," Matthews said.

The two can be seen yelling back and forth. At some point, witnesses say Lane threatened to spit in the drivers face, a threat she made good on.

"She grabbed him, started choking him... he said "you're going to jail now," no one expected what was coming," Matthews said.

Video shows what happened next.

Hughes uppercuts Lane and throws her off the bus. "She got up, took it like a woman... she got thrown, literally, he threw her off the bus," Matthews said.

Hughes, who has been suspended without pay pending the investigation, could not be reached for comment.

In his witness statement to police, he describes the events above. 

He acknowledges he says "he would hurt her," if she spit in his face as she said. He says he "stopped the bus" after she spit in his face.

He says he was only protecting himself. Lane did not return Channel 3's phone calls requesting an interview.

"Nuns on the Bus" stops in Cleveland

CLEVELAND--  After three days of travelling across the state of Ohio, "Ohio Nuns on the Bus" brought their passion for people here to Cleveland. 

The sisters weren't so shy about expressing their concerns over proposed policies. "This idea that we should give tax breaks to the wealthy and take away from programs... well that just doesn't make any sense," said sister Monica McGloin. 

Politics aside, nuns say they worry most about how our society's most vulnerable people will be impacted.  These are communities the nuns serve on a daily basis.   

Sister Mary Wendeln participated in the original "Nuns on the Bus" tour that traveled from Iowa to Washington D.C.  She helped organize a smaller scale campaign here in Ohio.  "We need to bring the topic of the poor back into the conversation on this electoral election season," said Sister Wendeln. 

They weren't telling people how to vote, only that it was important to do so. 

"People don't know what to listen to and what we're saying is our budget can't be balanced on the backs of the poor," said Sister Wendeln.

She added, "I think it is very successful because we come with a message that we as Catholic sisters want to change the rhetoric in the state of Ohio."

Freeze Watch issued for Friday night

CLEVELAND - A FREEZE WATCH has been issued for the lakeshore counties of northeast Ohio for Friday night.

This watch includes the following counties: Ashtabula, Cuyahoga, Erie, Lake, Lorain and Ottawa from late Friday night through early Saturday morning.

Temperatures will drop to the upper 20s and lower 30s after midnight Saturday morning and will likely harm or kill unprotected plants.

Precautionary/preparedness actions...

A freeze watch means sub-freezing temperatures are possible. These conditions could kill crops and other sensitive vegetation.
