Wichita State upsets Ohio State 70-66; heads to Final Four

Written By kolimtiga on Minggu, 31 Maret 2013 | 10.49

LOS ANGELES -- Malcolm Armstead scored 14 points, Fred Van Vleet bounced in a big basket with 1 minute left, and ninth-seeded Wichita State earned its first trip to the Final Four since 1965 with a 70-66 victory over Ohio State on Saturday.

Van Vleet scored 12 points as the Shockers (30-8) followed up last week's win over top-ranked Gonzaga with a nail-biting victory over the second-seeded Buckeyes (29-8), whose 11-game winning streak ended one game short of their second straight Final Four.

Wichita State roared to a 20-point lead with 11 minutes to play after Ohio State played an awful first half, but LaQuinton Ross scored 15 of his 19 points after halftime, leading a ferocious rally to within three points in the final minutes.

Ohio State entered the game riding an 11-game winning streak. The Buckeyes hadn't lost since mid-February. But they were tense early. And Wichita State exploited their struggles.

Neighborhood mourns victims of Bedford crash

MAPLE HEIGHTS -- Sorrow hangs over Watson Road in Maple Heights Saturday night as a street that acted like a family is mourning the loss of one of their own.

Neighbor Lana Johnson remembered hearing the news, "When I first found out I couldn't believe it, it was so hard. I thought it was a dream, I'm like it can't be real. It's crazy, it hurts so bad...it can't be real. I wish they were still here and I want them to know I love them and they're going to be missed dearly."

Neighbors are still trying to piece together their emotions after hearing that 30-year-old mother Maria Thorpe and two of her daughters were killed in crash in Bedford Friday night.

Maria, who was pregnant with her fifth child, was driving her four daughters back home from her mother's house when police say a 48-year-old Warrensville Heights man driving a pickup truck ran a red light and crashed into them.

Maria and two of her daughters, 8-year-old Zariah Roberts and 5-year-old Zyanah Roberts, died in the crash. Her 12-year-old daughter was released from the hospital and is staying with her aunt and her 10-year-old remains hospitalized in critical condition.

"They say she's moving her little fingers and she's okay, for now. Words can't even describe what they're going through right now and they're going to be missed," said heartbroken neighbor Alana Johnson.

Before the crash, Maria Thorpe was studying for her high school diploma and picking out baby names that begin with the letter Z.

Neighbors remember her as family, the lady that welcomed everyone to her pool parties and loved her children more than life itself.

The driver of the other vehicle was taken to an area hospital and then was taken into police custody after being treated. No charges have been filed, but they believe that alcohol may have been a factor.

Cleveland: 37th Film Festival countdown underway

Written By kolimtiga on Sabtu, 30 Maret 2013 | 10.49

CLEVELAND -- Cleveland's 37th International Film Festival is just five days away and its crew and an army of volunteers are scrambling to be ready when the curtain goes up at Tower City Wednesday.

The Festival will feature a record 345 films from 65 countries.

It's been expanded from last year's 11 to 12 days. For the first time, films are being shown in the surrounding cities of Akron and Oberlin.

The festival's stature as one of the largest in the eastern half of the United States is growing.

Associate Director Patrick Shepherd said, "We have a sterling international reputation. If you are in Europe and tell somebody you are from Cleveland, they will tell you you have a great orchestra and a great film festival."

The films include shorts, documentaries, ethnic films, women's films, "green" films and more.

The schedule is laid out on a wall and a half of post-it notes and is changing day by day.

For the latest information about the festival , go to www.clevelandfilm.org.

Opening Night Gala April 3

The Gala includes the film at 7 p.m. at Tower City Cinemas, followed by a "THE KINGS OF SUMMER" party at 9 p.m. at MK Ferguson Plaza in Tower City Center.

Volunteers are busy packing T-shirts, souvenirs and helping with last-minute details.

Lakewood's J.D. Frost considers himself a movieholic and is planning to attend 45 films.

"This is the best time of the year...These are films you probably wouldn't see at the local multiplex," he said.

20-year volunteer Bill DeCapite and his wife especially enjoy the short films.

"In the Oscars, they have shorts. You can't  see shorts unless you come to the film festival," he said.

Volunteer Katie Woods drives from Wellington to help. She is usually busy during the screenings and can't see the movies. She believes the movies are an important educational tool.

"I think it's important for people to hear about different cultures," she said.

Cleveland's growing role as a moviemaking center complements the festival.

"All the work the Film Commission does complements the work we do and vice versa," Shepherd said.

Many movies that are made locally are shown in the festival.

This year's opening night gala event is one such movie.

"The Kings of Summer" was made by Tyler Davidson, a local moviemaker of growing prominence who grew up in Chagrin Falls and now lives in Geauga County.

Last year, more than 85,000 film buffs attended the festival, pumping about $4.4 million into the local economy.

Brittyn Dewerth, who designed the artwork and logos for this year's festival, said, "It's energizing. It's educational and it's such a positive thing for Cleveland."

Festival promoters suggest those in Northeast Ohio coming down to Tower City take RTA, if possible, to avoid parking issues.

Strongsville strike: At what cost?

Written By kolimtiga on Jumat, 29 Maret 2013 | 10.49

STRONGSVILLE -- Striking teachers in Strongsville going on the offensive over what they claim is the real cost of the strike.

The teachers have been walking the picket lines for the past four weeks. Talks between the two sides broke down Tuesday after nearly 12 hours of negotiations.

The teachers union released new numbers today that they say comes from a public records request. They say the numbers show what the district is paying Huffmaster, the company providing the replacement subs and security for the district.

The numbers show over $338,000 for security officers, over $75,000 for several videographers to document striking teachers, $90,000 for van drivers to provide transportation to replacement subs, $183,000 for lodging for subs, $25,000 to pay gas, mileage, and tolls for replacements.

And payroll costs of over a half million dollars.

For a total price tag of $1.8 million.

The union also claims they have documentation that substitute teachers are being flown in from all over the country, costing the district another $50,000 in airline fees.

The union says the money is only part of the picture.

WKYC reached out to the district for a response and reaction to the claims but they have not returned our calls.

Emotional goodbye to slain Clinic nurse

CLEVELAND -- Friends and loved ones packed a Cleveland Heights funeral home to pay their respects to beloved Cleveland Clinic nurse and community figure.

That's how many will remember Aliza Sherman, killed in a brutal stabbing attack in downtown Cleveland Sunday.

More than 300 people filled overflow rooms, even stood in the lobby of the Berkowitz-Kumin-Bookatz Memorial Chapel while her children, her brothers and a friend shared their thoughts.

Aliza Sherman's children and siblings addressed mourners with memories of a kind and giving person.

She was described as a person who put others before herself, caring for those in her Jewish congregation at Green Road Synagogue, her family, and her patients.

Cleveland police say they're still investigating the stabbing near E. 12th Street.

They've not released a suspect description or images from surveillance video of the attack, caught on tape.

Detectives say they're currently interviewing witnesses and combing the area for details.

Anyone with information regarding this case is asked to contact those detectives at 216-623-5464; anonymous information can also be given to Crimestoppers.

Cleveland Weather: Patiently waiting

Written By kolimtiga on Kamis, 28 Maret 2013 | 10.49

It seems the cold will never end.

Today (thanks to some sunshine) we did indeed make it into the low 40s, but that is still well below average for this time of year.

Our patience is wearing thin.

By the weekend some warmer air will push into the area, but at the same time a cold front will be sweeping in.  That means temperatures near average for Easter, but rain will be with us.

Tonight: Isolated snow showers.  Accumulations generally less than 1", but could be up to 3" in the heart of the snowbelt.  Otherwise just variable clouds. Upper 20s/low 30s

Thursday: Mostly cloudy with scattered rain and/or snow chances. Upper 30s/low 40s

Friday: Partly sunny. Low 40s

Saturday: Partly cloudy. Upper 40s/near 50

Easter Sunday: Cloudy with rain likely.  Low 50s

Monday: Scattered snow (some mix) showers.  Windy.  Near 40

Tuesday:  Mostly cloudy with a slight chance for flurries.  Breezy.  Upper 30s

Wednesday:  Partly sunny.  Near 40

Police: No suspects yet named for slain Clinic nurse

CLEVELAND -- Services will be held Thursday for the Beachwood woman murdered downtown, as police continue to investigate her death.

A funeral is planned for 2 p.m. Thursday at the Berkowitz-Kumin-Bookatz Memorial Chapel on Taylor Road in Cleveland Heights.

An obituary for Aliza Sherman listed her as the loving mother of three sons and daughter, a cherished daughter, a dear sister and companion to her pets.

It makes no mention of her estranged husband Sanford Sherman.

The couple had been due in court this week for a contested divorce trial.

Police found Sherman outside Erieview Plaza Sunday, just steps from Stafford & Stafford, LPA, her divorce attorney's office.

When they arrived, police found Sherman covered in blood. EMS took her to MetroHealth Medical Center where she later died. Police say she still had her purse and it was unclear if anything was taken.

The Cuyahoga County Medical Examiner said Sherman died from 11 stab wounds.

Cleveland police are reviewing surveillance video of the incident. There have been no arrests made or suspects named.

Anyone with information about the incident is asked to call the Cleveland Police Homicide Unit at 216-623-5464.

An infertility nurse at the Cleveland Clinic, Sherman was beloved by her co-workers.

The Sherman family was part of the congregation at Green Road Synagogue. Rabbi Binyamin Blau told Channel 3 News he discussed the tragedy from the pulpit as Passover began. Blau said the holiday had delayed Sherman's funeral.

Friends who wish to make a memorial contribution are asked to direct funds to Rescue Village, Geauga County Humane Society's shelter, at 15463 Chillicothe Rd. Novelty, OH 44072 or The AIF Department c/o The Cleveland Clinic Foundation.

Browns sign QB Jason Campbell

CLEVELAND -- The Cleveland Browns have signed quarterback Jason Campbell to a two-year contract.

Campbell is expected to compete with Brandon Weeden for the starting job this season.

The Browns have been hinting they wanted to bring a veteran quarterback to compete with Weeden this training camp. After being drafted 22nd overall by the Browns in last year's draft, Weeden was given the starting job in the first week of training camp. Weeden went on to start 15 games in 2012 for the Browns and leading the team to only 5 wins.

Campbell has had a difficult time holding a starting job in his career. He struggled in Washington with bad teams. In Oakland he was injured in a game against the Browns in 2011 and then lost the job when the Raiders acquired Carson Palmer.

He went to Chicago last season as the backup for Jay Cutler and ended up appearing in 6 games.

So the Browns quarterback picture is now more defined. It is Brandon Weeden's job for now, but Jason Campbell will be there just in case.

Drafted by Washington in the first round in 2005, Campbell has 14,682 career yards and 76 touchdowns.

Breakdown: 'The Voice' season 4 premiere - night 1

Written By kolimtiga on Selasa, 26 Maret 2013 | 10.49

Here's a complete breakdown of Monday night's massive two-hour premiere of "The Voice" season four on NBC.

We will also live blog and live tweet throughout Tuesday night's one-hour episode, which starts at 8 p.m.

---

10 p.m. That's a wrap on the first episode of season four! What are your thoughts? Who is your favorite performer so far? How do you like Usher and Shakira as new judges? You can leave a comment in the section below or join WKYC in the discussion via Twitter using #TheVoice.

9:57 p.m. After tossing the thought around in her head, singer Judith Hill ultimately selected coach Adam Levine -- who predicted she would win the entire season. You can watch her full performance in the video featured at the top of this story.

9:54 p.m. Judith Hill quickly impressed all four of the coaches as each of them chose to spin around hoping she would join their team. Her performance of two-time "Voice" coach Christina Aguilera's "What A Girl Wants" brought everybody to their feet by the time she sang the final note. Now, the ball in his her court to choose which of the four coaches she wants to pair up with.

9:52 p.m. We're taken to Pasaden, California to meet Judith Hill who wrote her first song at the age of 4. She was also given the chance to work with Michael Jackson as a back-up singer before his sudden death. Judith reveals she was also somebody who performed at Jackson's memorial service.

9:48 p.m. Why wait for the next performance, which is coming up after the break? We have it for you to watch before it airs HERE.

9:46 p.m. James Irwin's performance of "The Man That Can't Be Moved" didn't garner any chair spins from the four coaches. Despite his disappointment, the coaches offered up well-wishes and encouraged him to come back and compete again.

9:43 p.m. Another emotional story was delivered by 30-year-old James Irwin from St. Louis, Missouri. In his pre-audition interview, James explains how his twin daughters died just several minutes after their birth. After that sadness, he and his wife were happily able to welcome a healthy baby boy last year.

9:36 p.m. Adam, Blake and Usher were stunned to see the person behind the voice -- Kris Thomas -- was actually a male because his performance featured very high tones. For that reason, the trio found themselves to be disappointed they didn't spin around, too.

9:33 p.m. 27-year-old Kris Thomas from Memphis, Tennessee explains how he lost a record deal before going into a deep depression and a battle with the bottle. Whitney Houston's "Saving All My Love For You" was his song choice, which won only Shakira over.

9:27 p.m. "So close," Usher whispered to Adam as Leah Lewis sang on stage. Despite the crowd's cheers, none of the four judges hit their red button -- all of them agreeing she just needs a bit more time to develop her voice.

9:23 p.m. 15-year-old Leah Lewis, currently from Orlando, Florida but originally from China, tells Carson Daly she's a country singer at heart. "I'm really hoping that Blake or Usher turn around," she nervously says before unleashing her version of Carrie Underwood's "Blown Away."

9:17 p.m. Coach Blake adds a third singer to his team after Christian Porter chooses him.

9:14 p.m. 21-year-old Christian Porter from Pennsylvania sings a very unique version of LMFAO's "Sexy & I Know It." His heavily slowed-down rendition almost made the pop hit sound like an entirely different song. The crowd -- and more importantly, the judges -- loved the performance as Shakira, Blake and Usher spun their red seats around. Coach Adam was the only one who didn't spin around because the performance perplexed him.

9:12 p.m. Adam Levine remains the only coach without a team member yet.

9:07 p.m. Before going to commercial, host Carson Daly again teases a moment that will surprise the judges.

9:03 p.m. Vedo hopes to woo Usher by singing Justin Bieber's "Boyfriend." After it seemed no coaches were going to fight for him, Usher smacked his button and became the only judge to spin around. His family -- including his mother -- erupt into cheers backstage.

9:02 p.m. We're introduced to 19-year-old Vedo, the first contestant this season to go by a single name. Before taking the stage, he tells a heart-wrenching story about his mother who has been given just two months to live after a diagnosis of stage-four lung cancer. "She's my everything," he says, fighting back tears. "I just don't want to lose my mama."

9 p.m. The first hour of the two-night premiere ends with Danielle Bradbery excitedly choosing to team up with country star Blake Shelton -- a definite no-brainer decision since she's a young country gal herself.

8:55 p.m. We're left with a cliffhanger moment heading into a commercial break wondering if 16-year-old Danielle Bradbery will team up with Blake, Adam or Usher. Who do you think she should pair up with? Leave your thoughts in a comment below, or join WKYC on Twitter using #TheVoice.

8:54 p.m. After Shakira admits she feels stupid for not turning around, Usher uses Justin Bieber tickets as his method to convince Danielle Bradbery to join his team before mistakenly referring to Nashville as a state.

8:51 p.m. 16-year-old Danielle Bradbery takes her turn in the spotlight singing Taylor Swift's "Mean." Being the first country song of the season, it seemed like coach Blake would be the first to spin his seat around. But he wasn't. Usher slammed his red button first with Blake following suit just seconds later. Tears poured backstage as her family watched her performance on stage. When coach Adam opted to push his button, Blake rose to his feet and jokingly yelled at him to spin back around.

8:42 p.m. After becoming the first contestant featured this season, Janetza Miranda is brought to tears that no coach wanted her on their team. Instead of beating her down Simon Cowell-style, the four coaches offered words of advice and encouraged her to continue her pursuit in the music biz.

8:40 p.m. Janetza Miranda introduces us to her unique "bird call" technique before performing "Titanium." Her family dances excitedly backstage, but none of the four coaches push their button although Shakira did come close.

8:36 p.m. We're in yet another commercial break. What are your thoughts so far? Leave a comment below or send WKYC a tweet using #TheVoice. Are you enjoying Usher and Shakira as new coaches?

8:34 p.m. "You have a really nice way of kind of maneuvering around those notes," coach Adam tells singer Mark Andrew. He wound up picking to team up with Shakira.

8:32 p.m. Adam is the first to hit his red button, followed by Shakira as Mark Andrew sings "Knockin' on Heaven's Door." Mark revealed in his pre-audition interview that he's hoping to succeed on "The Voice" so he could quit his job as a roofer.

8:31 p.m. Minneapolis roofer Mark Andrew, 27, tells an emotional story about the deaths of two of his bandmates, calling both guys his "guardian angels" before taking the stage.

8:26 p.m. As the second commercial break airs, the tally stands as follows: Team Blake has the Morgan twins as Usher has teamed up with Jess Kellner. Neither Shakira nor Adam have any singers on their team yet.

8:24 p.m. After some thought, Jess Kellner chooses Usher.

8:23 p.m. Shakira and Usher, the two new coaches, push for Jess Kellner to join their team. Blake joked that Shakira was crushing Usher competing to get her to join his side.

8:21 p.m. 21-year-old Jess Kellner from Austin, Texas is the second contestant to take the stage. "I want to do big things for my family," she says.  Shakira and Usher quickly slap their buttons and swing their tall, red chairs around. "Wow," Usher utters as she sings "Can't Help Falling In Love With You."

FIRST COMMERCIAL BREAK 8:16 p.m. Why wait for another audition? Check out Judith Hill's upcoming, crowd-pleasing performance before it airs HERE.

8:14 p.m. After each of the four coaches dished their pitch to have the Morgan twins choose them, the singing sisters ultimately picked to pair up with Blake Shelton. That choice comes as a surprise because both women in their pre-audition interview gushed over the chance to work with Usher. "That was the hardest decision of my life," one of the sisters explains.

8:09 p.m. The Morgan sisters -- the first twins to ever audition on "The Voice" -- are also the first to hit the stage. Usher and Blake Shelton smash their red buttons almost immediately, flipping their chairs around to get a glimpse of the duo. Adam Levine and Shakira also hit their buttons before the song is over, leaving the choice on which coach to choose in the Morgan sisters' hands.

8:05 p.m. The four coaches -- returnees Adam Levine and Blake Shelton with newbies Shakira and Usher -- slam the stage with their own rendition of "Come Together" by the Beatles. The studio audience erupts in thunderous applause.

8:04 p.m. Host Carson Daly says the sole winner will be given a recording contract with Universal Music Group before teasing "one of the biggest surprises in 'Voice' history" that will shock the coaches.

8:02 p.m. Two-time "Voice" coaching champ Blake Shelton says the blind auditions are like Christmas morning.

8 p.m. Usher introduces himself as a coach saying he wanted to be a part of "The Voice" since it's a show that has credibility.

Euclid: Video show dramatic rescue from burning truck

EUCLID -- Three Euclid police officers are credited with saving the life of a man trapped in a burning truck.

The 911 call came in Saturday, just before 11 a.m. from a witness on Babbitt Road.

A man was driving a pickup truck southbound, when he crossed the yellow line, hit a light pole, then doubled back across the road and scraped through landscaping before coming to a stop next to the brick building of The Illuminating Company.

Three officers from the Euclid Police Department arrived on scene before fire fighters.

The pickup was pouring smoke and engulfed in rapidly growing flames.

"I could see the man's hand on top of the vehicle, and right then and there I radioed dispatch to have fire and rescue step it up," said Euclid Police Officer Jose Alcantara.

Officers Jose Alcantara, Adam Beese and Corey Screngi used batons to break the windows on the pickup cab, and release billowing smoke.

One of the policemen then ran to the driver's side, and used a knife to cut the seatbelt and free the unresponsive driver.

"If it would have taken us a minute more to get there, he would have died in that engulfed vehicle," said Alcantara.

Fire fighters got there soon after, and quickly extinguished the flames.

But Platoon Chief Will Anderson of the Euclid Fire Departmentsays, had the police not arrived when they did, it would likely have been too late to save the man.

"After watching the video footage, there was a 60-90 second period of time where the cab of the vehicle was not in flames yet. That was where Euclid police went to work and basically saved this individual's life," said Anderson.

The entire rescue was caught on camera.

The Euclid Police Department is testing new technology in patrol cameras: small devices the size of a AA battery, that clip onto glasses.

It allows the officers to record exactly what they see, and in this case, that meant a dramatic rescue.

That driver was taken to Hillcrest Hospital, where he was treated for smoke inhalation and released.

None of the officers suffered injuries in the rescue.

As for what caused the crash: police say the driver was under the influence of drugs, and lost control of his vehicle.

38-year-old Zahrod Tolbert is charged with reckless operation of a vehicle and OVI.

"I think the driver of that vehicle was very lucky that we had plenty of units in the area to get there as fast as we did, and to get him out of that vehicle before he would have engulfed with the vehicle in flames and lost his life," said Alcantara.

CLEVELAND -- Police and homicide detectives are investigating the death of a woman who was found covered in blood.

Police received a call around 5:30 p.m. Sunday for a woman screaming near 75 Erieview Plaza.

When they arrived, police found a 53-year-old woman covered in blood. EMS transported the victim to MetroHealth Medical Center where she later died.

Police Sgt. Sammy Morris says the woman had multiple "defects to the torso" but would not say whether or not they were gunshot wounds. Multiple yellow evidence markers could be seen in the area.

The Cuyahoga County Medical Examiner will conduct an autopsy to determine how the woman died.

Homicide detectives processed the scene and are conducting an investigation.

The victim's car was found nearby and was towed from the area.

Morris continued to say that police "rarely have problems" downtown.

Anyone with information about the incident is asked to call the Cleveland Police Homicide Unit at 216-623-5464.

Linndale: Mayor's Court dead but speed trap is not

Written By kolimtiga on Jumat, 22 Maret 2013 | 10.49

LINNDALE -- For those concerned about being caught going too fast on I-71 while going through Linndale's notorious speed trap, there is good news and bad news.

The good news is the infamous mayor's court which processed around 4,000 tickets a year making money that kept the postage-stamp-sized village alive is dead.

A Franklin County judge rejected an appeal of a just-passed law eliminating mayor's courts in towns with fewer than 200 people.

Officially, Linndale has 178 residents.

The bad news is, police plan to keep on keeping on writing tickets.

Sgt. Tim Franczak said, "We are not going to change one iota...we're going to enforce the laws of Ohio and the village of Linndale."

The only difference? Those ticketed will now have their cases handled by Parma Municipal Court.

Speeders with scheduled Linndale court dates will get letters with a new Parma court date.

Parma Court officials are making plans for the switch. Linndale is one of eight communities with cases handled in Parma.

State Senator Tom Patton who sponsored the measure said the goal was to take out both the courts and the speed traps.

He says he remains committed towards that goal and said it would be "disappointing" if that's not how things played out.

The question is, will Linndale still get enough revenue to keep the village alive?

It will get fines minus court and membership costs to have its cases handled in Parma.

The villages also are expected to appeal the court ruling.

Patton said there will soon be increased Ohio Highway Patrol presence on the local stretch of I-71.

Perspective: My unwitting, unwilling role in GOP political ad

Written By kolimtiga on Kamis, 21 Maret 2013 | 10.49

CLEVELAND -- I recently returned from a glorious week of vacation and was met with an unwelcome surprise.

I'd been recruited as a messenger for the Ohio Republican Party.

An excerpt of one of my previous 2010 stories about Cuyahoga County Ed FitzGerald had been "borrowed" by Ohio's Republicans in a video web ad bashing Cuyahoga County Executive and expected Democratic Governor candidate Ed FitzGerald.

I was never asked for permission. I was not even informed of my cameo role.

For that lapse of courtesty, a Republican spokesman apologized.

On www.PublicOfficial14.com, a video uses my narrative to describe how then-County Executive candidate FitzGerald was running as a corruption-fighting Mr. Clean candidate.

I said disclosure of his bit player role in the Jimmy Dimora corruption scandal "won't help him."

When the original story was delivered, I was on camera standing in front of the County Administration Building for a news story.

In the Public Offical 14 website commercial, my unidentified voice accompanies a silhouette of FitzGerald projected over legal paperwork about Public Official 14.

There is no obvious disclaimer that the ad's soundtrack came from a Channel 3 newscast.

To refresh, as Lakewood Mayor, FitzGerald took a wiretapped phone call from then-Democratic Chairman and County Commissioner Jimmy Dimora.

Dimora wanted FitzGerald to meet with William Neiheiser. Neiheiser was bucking for a contract to run the Lakewood Ice Rink, which he eventually got.

Neiheiser later made a contribution to FitzGerald which FitzGerald later returned. Neiheiser was eventually charged and convicted in the Cuyahoga County corruption probe for other issues not related to FitzGerald.

FitzGerald denied any wrongdoing. He said he just took a phone call from a party and public official.

Ohio's GOP Executive Director Matt Borges said, " It allows us to use a publicly  aired news account of what happened to point out Ed FitzGerald is in fact Public Official 14 and did a favor for Jimmy Dimora involving someone who is now in prison."

The Justice Department made an extraordinary statement clearing FitzGerald of being a corruption target probe.

Republicans are connecting the dots in a way to suggest FitzGerald's part of the county's dirty old political past.

But their tactic of blurring newscasts and political propaganda is part of a dirty new political present.

More and more political ads are "borrowing" from newscasts mixing journalist's credibility with campaign messages.

Many viewers and voters are increasingly turned off by political ads. They think they are dishonest or biased, which they often are.

They may think that of some journalists too. But even in this new media world where fact and opinion overlap, most of us strive to be fair, honest and accurate.

And we don't want do be burdened with the extra baggage of being perceived as political shills.

We want to cover not make news and view "borrowing" newscasts as raising ethical questions.

Tom Brokaw was upset when an old NBC Nightly newscast turned up in a Mitt Romney ad targeting Newt Gingrich.

"I don't like it...It's so hard to stay in what I call the umpire mode," he said.

Fair usage law does allow political commercials to incorporate newscast excerpts as long as they are not being used to make money.

Late Wednesday afternoon, a Republican spokesman told me the party plans to voluntarily take down the video.

Gannett, the corporation that owns Channel 3, was preparing to request that.

Perhaps Republicans decided to avoid a needlessly controversial story, even if most would see it as "inside baseball."

But a story would likely have driven more eyeballs to the website to see what the flap was about.

They will replace the video with more shots at FitzGerald.

So just to clarify if need be, I am not working for the Republicans,Democrats,  Governor John Kasich or Ed FitzGerald.

I'm working for you.

Channel 3 News Anchor Kris Pickel was given a unique opportunity to go behind-the-scenes at the Greater Cleveland Aquarium, which included a dive in the shark tank.

TJ Lane's sister gives condolences to victims families

Written By kolimtiga on Rabu, 20 Maret 2013 | 10.49

CHARDON -- T.J. Lane's family made a brief statement after the sentencing hearing outside the courtroom.

His younger sister, Sadie Lane, read a written statement about how she has tried to deal with all that has happened in the last year.

Sadie was in the cafeteria the day of the shootings. She says she has kept the victims' families in her prayers and asked that her family be remembered too.

"The brother in the courtroom and the brother who did this are not the brother I knew."

Sadie says has come to believe that only hope and compassion can help the community heal.

The family had to wait to make its statement, because T.J. Lane told his lawyer he did not want anyone to speak on his behalf in court.

Cleveland: Reed removed from Council committees

Written By kolimtiga on Selasa, 19 Maret 2013 | 10.49

CLEVELAND -- A once-possible vote by Cleveland City Council to remove Councilman Zachary Reed in the wake of his third drunken driving arrest will not happen.

The city law department provided an opinion that council had no power to remove a member for personal misconduct having no link to his official duties.

But Council President Marty Sweeney is empowered to both assign and remove members from committees.

On Monday, he removed Reed from his seats on Legislation, Health and Human Services and Public Parks, Recreation and Properties committees.

Sweeney said he made the moves to allow Reed to focus on his legal case and personal issues.

Reed, 51, was pulled over by police shortly before 2 a.m. earlier this month near East Ninth Street and Rockwell Avenue on suspicion of drunken driving.

He was arrested and charged and spent the night in the Cleveland City Jail.

Related story: Flask: Zack Reed got special treatment in City Jail

It's unclear if Sweeney would have had the necessary 13 votes to oust Reed if city lawyers determined Council was empowered to do that.

Solon, Willoughby women recovering after Florida crash

PANAMA CITY, Fla. -- Two Northeast Ohio women driving home from spring break died and seven others remain hospitalized after a traffic crash in the Florida Panhandle Saturday morning.

Diana Mitchell, of Solon, and Lauren Kane, of Willoughby, both 22, were passengers in the car driven by Brittney Gallagher, 21, of Willoughby. Also in the 2000 Dodge 4-door car was Courtney Miller, 21, of Niles.

Gallagher and Miller were pronounced dead at the scene and Mitchell and Kane were taken to Bay Medical Center in critical condition where they remain Monday.

On Monday afternoon, Mitchell was listed in stable condition and Kane was listed in guarded condition.

All four were Ohio State University students. Gallagher was a 2009 graduate of Lake Catholic High School, while Miller was a 2009 graduate of Niles McKinley High School.

The Florida Highway Patrol crash report states that Gallagher was driving near Ebro on Saturday morning when she drifted into oncoming traffic.

Troopers said Gallagher's attempts to correct the problem caused her vehicle to rotate and cross into the path of a 2006 Dodge pickup truck driven by Kelly Porter of Stillwater, Okla.

Gallagher and Miller were pronounced dead at the scene and both were wearing their seatbelts.

The driver of the pickup, 26-year-old Kelly Porter of Stillwater, Oklahoma and three of his four passengers, 22-year-old Tyler Magar of Yukon, Oklahoma, 23-year-old Courtney Burnett of Edmond, Oklahoma and 21-year-old 21 Matt Gallant of Oklahoma City, were all taken to Gulf Coast Medical Center in serious condition.

Braden Solis, 21, of Oklahoma City suffered minor injuries.

Authorities said alcohol was not a factor in the crash.

Porter, Solis and Magar are students at Oklahoma State University. Gallant attends the University of Oklahoma. Burnett goes to Southeast Missouri State.

Detectives with the Jefferson County Sheriff's Office alerted the Attorney General's Bureau of Criminal Investigation to the online threats soon after Sunday's sentencing hearing concluded.

The Steubenville girls, 15 and 16, were both taken to the Jefferson County Juvenile Detention Center upon arrest.

The 16-year-old is charged with one misdemeanor count of aggravated menacing for threatening the life of the victim on Twitter.

The 15-year-old is charged with one misdemeanor count of menacing for threatening bodily harm to the victim on Facebook.

He said BCI, Steubenville Police and the Jefferson County Sheriff's office collaborated in the investigation.

Steubenville Police Chief Bill McCafferty said police arrested the two girls around 4 p.m. Monday.

A posted tweet from someone claiming to be a cousin of one of the convicted football players said, "You ripped my family apart, you made my cousin cry, So when I see you b##ch, it's gone ba a homocide.

Attorney General Mike DeWine told Tom Beres "We take any kind of threat seriously....Every rape case is a tragedy. Every rape case is difficult for the victim, but she has continued to be victimized by people in the social media."

DeWine said a grand jury will decide if anyone..football coaches, school officials, parents or teens...tried to cover up the rape to protect the community's proud football program.

"What I owe the people of Steubenville is two things. One of them is to get this over as fast as we can. But it's also important we get it over right," he said.

Sixteen people refused to cooperate with investigators.

"There certainly could be more charges...This will be many days and we will have many more witnesses."

At Cleveland's Rape Crisis Center, publicity about the Steubenville case is encouraging more women to call to report assaults, old and recent.

Center President Megan O'Bryan said, "We have seen a definite spike in calls."

Normally the center gets a couple victim calls per week. Lately it's been getting eight or nine calls per day.

"We're kind of hitting a tipping point where people are saying this behavior is not acceptable," she continued.

She supports DeWine's grand jury probe.

"Let's look at a system that may have silenced this or protected the perpetrators....If anyone tried to sweep this under the rug, I think they need to be held accountable," she declared.

The center is working with Steubenville schools to develop and implement rape prevention and education programs.

Many counties in Ohio lack a Rape Crisis Center counterpart.

Ohio does not fund such programs. DeWine said Wednesday he will release a study about that and suggested that may also include plans for new funding.

Steubenville: Judge to render verdict Sunday morning

Written By kolimtiga on Minggu, 17 Maret 2013 | 10.49

STEUBENVILLE -- It's day four of the teen rape trial in Steubenville where prosecutors and the defense both rest their cases following the 16-year-old accuser's testimony.

Evidence was entered into record and closing arguments were given by both sides. Today's court session ended around 8 p.m.

Judge Lipps is expected to rule on the case at 10 a.m. Sunday.

The party and her drinking came under questioning.

The alleged victim is 16 years old. She wore glasses and spoke deliberately. Her tone was timid and a little unsteady.

She remembers little of that night, but with conviction she tells Judge Lipps what she drank and the way she felt for days after.

The alleged victim frowned when she saw a photo from that night blown up in the courtroom. When she was handed a nude photo text message sent among teen partygoers, she broke down and cried.

"I was just not myself. I wasn't being myself," the girl said.

The girl testified she had a mixed drink, some red alcoholic punch and a shot. She remembers leaving the end of the summer party with defendant Trent Mays but not Ma'lik Richmond.

"I remember walking down the steps and in the street . That was it," she said.

The prosecution says the girl was sexually assaulted by both defendants,l once in the back seat of a car and a second time in the basement where she woke up.

"It was really scary. I was embarrassed and scared. I didn't know what to think. I couldn't remember. I woke up with no clothes on. I didn't know what happened at all, " the alleged victim said.

Pictures of the alleged victim's tweets and text messages were all the girl had to put the night before together.

A friend told her to watch a Youtube video. It's former Steubenville high athlete Michael Nodiamus telling the world wide web she was raped.

The girl's testimony wrapped up the prosecution's case. The defense had already had some witnesses take the stand, out of order, to accommodate travel.

More from the alleged victim and the debate over how drunk is too drunk to make informed decisions at 11.

Graphic sexual testimony in Steubenville rape trial

Written By kolimtiga on Sabtu, 16 Maret 2013 | 10.49

STEUBENVILLE -- Eyewitnesses in the rape trial of two Steubenville High School students gave sexually explicit testimony Friday.

Defendants, 17-year-old Trent Mays and 16-year-old Ma'Lik Richmond face rape charges. They are accused of sexually assaulting an intoxicated 16-year-old girl after a party last summer.

Mark Cole, a friend of the defendants and a high school senior, took the stand Friday. Cole says he was there the night of the alleged sexual assault.

Cole testified that he saw defendant Mays penetrate the victim with his fingers in the back seat of a car. Cole told the court he then took out his phone and started recording.

Cole testified to drinking eight to 10 beers that night in just two hours time. In Cole's basement, the witness testified Mays attempted to force the alleged victim to perform oral sex. When she didn't respond Cole says Mays stopped. At the time, Cole said the girl was on her side on the floor of the basement. She had just thrown up.

Cole testified neither sex act was consensual.

During cross examination, the defense, through questioning, suggested the sex was consensual and argued that the victim was not too intoxicated to decide for herself.

Cole testified he was intimidated by police questioning about that night. He has received immunity from prosecution for his testimony.

After Cole's testimony, the court heard from a second eyewitness.

Evan Westlake, 18, testified he was with the defendants, Mays and Richmond, when the alleged sex assault on the 16-year-old victim took place.

Westlake says he was driving the car when Mays allegedly used his fingers to assault the victim.

Westlake told the court he didn't see what was happening in the backseat but heard Mays laugh and then say to Cole, "get this." Cole had earlier testified he recorded the sex act on his cell phone.

Westlake says he was also in the basement where the prosecutor alleges both defendants sexually assaulted the girl at the same time. Earlier testimony indicated the girl, who was severely intoxicated, was incapacitated at the time.

When asked why he didn't do anything about it the teen responded by saying he didn't expect to see something like that. "It wasn't violent. I didn't know what rape was. I pictured it as forcing yourself on someone," Westlake said.

Through cross examination the defense suggested Westlake didn't do anything about it because in earlier testimony Westlake said he didn't see anything bad.

Justice Department investigating Cleveland Police

Written By kolimtiga on Jumat, 15 Maret 2013 | 10.49

CLEVELAND -- The U.S. Department of Justice today launched an investigation into whether there is a widespread practice within the Cleveland Police Department of officers using excessive force during their encounters with citizens.

Cleveland Mayor Frank Jackson and other community leaders had asked for the Justice Department investigation following the Nov. 29 fatal shooting of two motorists in a hail of bullets fired by officers who had pursued the suspects for 26 minutes.

"We are focused on CPD as a whole," said Assistant Attorney General Thomas Perez of the Civil Rights Division. "We are not looking at individual officers."

Perez says the investigation will focus on the allegations of excessive force by officers as well as whether the Police Department has the proper training, supervision and oversight to prevent such actions.

It will also look at "whether officers are held accountable if they stray from departmental rules and regulations and constitutional norms," said U.S. Attorney Steve Dettelbach, who oversees the federal prosecutors in Cleveland.

Perez said the review is expected to take "as long as necessary," although Justice Department personnel will be in Cleveland for months to speak with community, political and police leaders about their concerns.

The end result of the DOJ investigation will determine whether reforms are needed in the department.  It is a civil review not a criminal one.

Jackson says he welcomes the review.  He says the investigation is necessary to maintain trust between the people of Cleveland and the officers who are sworn to protect them.

"If there are ... suggestions to us that we need to do better in areas, then we will gladly change because our goal ... is to have a professional police division," Jackson said.

Victim in Steubenville rape trial says boys took advantage of her

STEUBENVILLE -- The rape trial involving two teens from Steubenville is in its second day. Today's testimony focused on cell phones and text messages sent in connection with the case

Prosecutors have introduced graphic text messages in the trial of two Ohio high school football players charged with raping a 16-year-old girl.

The texts include messages from the alleged victim in which she says she doesn't remember anything the night of the attack and is trying to find out what happened.

The girl also implies that she believes she was drugged that night and that others were "taking advantage of me."

The texts introduced Thursday in Jefferson County Juvenile Court also included ones in which 17-year-old defendant Trent Mays admitted that he digitally penetrated the girl.

Mays and his co-defendant, 16-year-old Ma'Lik Richmond, maintain their innocence.

The case has riveted the small city of Steubenville amid allegations that more students should have been charged.

Westlake: $41M winning Mega Millions ticket sold at deli

WESTLAKE -- The single winning ticket for the $41 million Mega Millions Jackpot was sold in Westlake.

The winning ticket for the March 12 drawing was sold at Deli 4 Less on Center Ridge Road. Owner, Mark Hadad received an honorary check of $41,000 for selling the winning ticket.

Channel 3 News has confirmed a group of coworkers from TA Travel Centers are the lucky winners. Deli 4 Less is a frequent lunch spot for the employees.

"It's been lucky. I think it's been lucky, we've been selling a lot of winners, but not a big one like that," said Hadad.

"They buy a bunch of tickets all the time together. They always come in and they are excited," said Hadad of the winners.

A group of 14 employees from just two doors down at the corporate office for TA Travel Centers split the tickets, choosing their own numbers. Hadad says two women came in to purchase about $50 worth of tickets yesterday at lunch.

"It's exciting for us to be the person that sells it after two years," he said.

If the winners take the cash payout, the jackpot's worth $21.3 million, or about $1.5 million each.

If they do annuity payments, they'll each take home nearly $79,000 a year for 26 years.

While the lucky winners haven't shared their names, we expect they're sure to be good money managers.

A spokesperson for the group tells Channel 3 News all 14 members work in accounting.

"I'm wishing today if we can hit the Powerball, we'll be back to back," said clerk Nick Abuasi, who sold the winning ticket.

The group's spokesperson says all the winners showed up for work today. They're still letting it sink in before making plans for the big jackpot.

The Mega Millions jackpot win is the 17th for Ohio.

Prosecutors said Beasley and Brogan Rafferty used the job postings as bait in a robbery plot aimed at down-on-their-luck victims with few family ties that might highlight their disappearance.

Beasley's teenage co-defendant Brogan Rafferty, too young to face the death penalty, was convicted in late 2012 and sentenced to life in prison without chance of parole.

Jurors reconvened on Tuesday at 9 a.m. to resume deliberations after receiving the case late Monday afternoon. Jurors were sequestered overnight during their deliberations.

AP: Attorneys seek dismissal of Steubenville rape case

Written By kolimtiga on Selasa, 12 Maret 2013 | 10.49

COLUMBUS -- Attorneys for a high school football player facing rape accusations in Ohio are asking a judge to dismiss the case against him because they say the "unavailability of material witnesses" denies him his right to a fair trial.

A West Virginia judge last week rejected requests three juveniles be called to testify at the Steubenville trial of two high school football players charged with raping a 16-year-old girl.

The girl is from West Virginia. The juveniles' testimony was expected to bolster the players' defense against the charges.

Attorneys representing defendant Trent Mays on Monday filed a motion to dismiss, which was obtained by The Associated Press.

The two players go on trial Wednesday in Jefferson County juvenile court in Steubenville. Their attorneys have denied the charges.

Middlefield: Driver shot, killed is identified

MIDDLEFIELD -- Just before noon Monday, Geauga County Coroner, Dr. Robert Coleman has identified the man shot and killed by police officers Sunday.

Coleman said the man was James L. Gilkerson, 42, of Mentor-on-the-Lake.

A shooting involving police officers happened around 6 p.m. Sunday on Old State Road.

Two Middlefield police officers were shot by Gilkerson during what was believed to be a routine traffic stop. Police referred to the gun as a semi-automatic rifle.

Police say Officer Brandon Savage and Officer Erin Thomas pulled Gilkerson over while on patrol. Before they could exit their cruiser, he got out of his car and fired at the officers.

Officers then exited their cruiser and returned fire, killing Gilkerson.

Officer Thomas was shot in the hand. She was taken by a University Hospitals MedEvac helicopter to MetroHealth Medical Center. She is still in the hospital and will be released in a day or two.

Officer Savage was hit in the leg by shrapnel and was taken to University Hospitals Geauga Medical Center for treatment.  He has now been released and is at home healing.

Sheriff Dan McClelland says nothing indicated to officers that the stop wouldn't be routine. Investigators are trying to determine what may have caused the incident to escalate so fast.

McClelland says, at this time, they haven't been able to determine how many shots were fired.

Cleveland Weather: Wintry reality

A line of heavier showers with some rumbles of thunder and gusty wind will move through tonight.  These are coming just ahead of a cold front that will take us back into wintry reality tonight.

With the colder air moving in, snow showers will be possible from time-to-time Tuesday around northern Ohio.

It looks like the wind will begin to align Tuesday night and Wednesday to allow Lake Erie to pump in some snow showers.  Accumulations (which will be rather light...perhaps only a few inches), but after we've felt temperatures in the 60s this isn't the best of news.

We will be sneaking back toward average highs (mid 40s) for this time of year later in the week and into the weekend.  Rain chances will be coming along for the ride too.

Tonight:  Rain (some rumbles early) changing to scattered snow showers pre-dawn.  Breezy.  Mid 30s

Tuesday:  Scattered flurries.  Little accumulation, if any.  Breezy.  Upper 30s

Wednesday:  Cloudy with scattered snow showers.  Accumulations possible in the snowbelt.  Mid 30s

Thursday:  Mostly cloudy.  Mid 30s

Friday:  Partly cloudy.  Low/mid 40s

Saturday:  Rain showers likely.  Low 40s

Sunday - St. Patrick's Day:  Mostly cloudy and cool.  Near 40 (we will try to keep it dry!...hoping for some luck-o-the-Irish!)

Monday:  Mostly cloudy with scattered rain showers.  Low 40s

ODOT: I-90 EB expected to open 'momentarily'

Written By kolimtiga on Senin, 11 Maret 2013 | 10.49

CLEVELAND -- For now, interstate 90 remains closed in both directions. However, crews expect the eastbound direction to open Sunday night. The westbound lanes are expected to open by 2 a.m. Monday.

The highway was closed following an accident where a dump truck with a raised trailer crashed into a pedestrian bridge above Interstate 90.

The accident happened on the I-90 westbound lanes between E. 156th Street and E. 185th Street around 6:45 a.m Saturday.

Police say a truck from Big Blue Trucking out of Warren, Ohio, was traveling with a raised trailer when it hit the bridge. After hitting the bridge, the truck then rolled over.

Unsafe conditions forced the Ohio Department of Transportation to bring in cranes to dismantle the pedestrian bridge that was damaged.

ODOT wants to have the highway fully open by 2 a.m. Monday.

"ODOT will not reopen I-90 until it is 100% safe for the traveling public to drive though this area." said Amanda Lee.

Comet becoming visible in the night sky

CLEVELAND - The middle part of March is bringing a new type of celestial show with the Comet Pan-Starrs becoming visible to the naked eye including in northeast Ohio.

Skywatchers across North America have begun reporting sightings of the comet as it makes its closest approach to the sun, just inside the orbit of Mercury over the next few weeks.

The comet will glow as bright as a magnitude two star, making it visible to the naked eye.

The best viewing times will be right after sunset. Be sure to look low and west once the sun passes the horizon. Never look directly into theh sun.

March 12th and 13th will kick off some of the best viewing opportunities as the comet appears to pass not far from the moon that will be in its crescent phase at that time, provided skies are cloud-free.

The comet will remain visible until early April as it moves away from the sun and disappears back into the depths of space.

Akron: Alex Abreu released from jail

Written By kolimtiga on Sabtu, 09 Maret 2013 | 10.49

AKRON -- Alex Abreu, the starting point guard for the Zips, has been released from jail.

Abreu and his co-defendant left the Summit County Jail late Friday afternoon.

Earlier Friday morning, Abreu faced a judge via video arraignment on drug charges. The judge set a $5,000 bond for Abreu.

The 21-year-old was arrested Thursday and charged with possession and trafficking in marijuana after police say he allegedly accepted a package containing five pounds of marijuana.

Abreu has pleaded not guilty to the charges.

The Zips have indefinitely suspended Abreu pending the outcome of the police investigation.

Akron (24-5, 14-1) secured its second consecutive Mid-American Conference title when it beat Miami of Ohio 72-58 on Tuesday night. The Zips host Kent State on Friday night in their final regular-season game.

Abreu, who is from Puerto Rico, has been the team's floor leader during a memorable season. The Zips recently won 19 straight games and will be the No. 1 seed in next week's Mid-American Conference tournament. The MAC tourney winner receives the league's automatic NCAA bid.

Abreu is averaging 10.3 points and six assists per game. The 5-foot-10 junior also shoots 81 percent from the foul line.

Akron: Abreu's absence felt in Zips' loss to Golden Flashes

AKRON -- The absence of the University of Akron's star point guard was felt on the court and in the stands at James A. Rhodes arena.

The final score against rival Kent State: Zips - 64, Golden Flashes - 68.

21-year-old Alex Abreu was arrested by Akron Police on Thursday.

Police charged Abreu and another man with trafficking and possession of marijuana.

Abreu posted bond Friday evening but is suspended from the basketball team.

Fans say his absence was noticed in the final game of the regular season.

"I thought we were definitely going to take a hit," University of Akron student Evan Gannon says. "Losing Abreu was a big loss, but I think the Zips can pull together. We're a pretty good team."

Alums Kathy and Kurt Davis are disappointed with Abreu and what it could mean for the team's morale.

"I was shocked, first of all. I can not believe that someone with that much opportunity would screw it up for himself and the team going into the post-season," Kathy Davis said.

Abreu has a court appearance on March 22.

Before that date, the Zips will have to win the MAC Championship next week in Cleveland if they hope for a bid to the NCAA tournament.
