CLEVELAND -- A once-possible vote by Cleveland City Council to remove Councilman Zachary Reed in the wake of his third drunken driving arrest will not happen.
The city law department provided an opinion that council had no power to remove a member for personal misconduct having no link to his official duties.
But Council President Marty Sweeney is empowered to both assign and remove members from committees.
On Monday, he removed Reed from his seats on Legislation, Health and Human Services and Public Parks, Recreation and Properties committees.
Sweeney said he made the moves to allow Reed to focus on his legal case and personal issues.
Reed, 51, was pulled over by police shortly before 2 a.m. earlier this month near East Ninth Street and Rockwell Avenue on suspicion of drunken driving.
He was arrested and charged and spent the night in the Cleveland City Jail.

It's unclear if Sweeney would have had the necessary 13 votes to oust Reed if city lawyers determined Council was empowered to do that.
